- 34 - <br /> <br />legal or arbitration proceeding (exclusive of any proceeding <br />authorized under this Article XIV) arising between the <br />Association and an Owner or Occupant, or between Owners or <br />Occupants, because of an alleged default or violation by an Owner <br />or Occupant, the Association shall, if it prevails as to any.,. <br />material part of the relief sought, be entitled to recover the <br />costs of the proceeding and such reasonable attorneys' fees as <br />may be determined by the court or arbitration board. In any <br />situation in which the Association has incurred costs and <br />expenses, including attorneys fees, in order to collect unpaid <br />monthly assessments or to correct any other default or violation <br />by an Owner or Occupant of the provisions of the Governing <br />Documents, the Owner or Occupant who has caused the Association <br />to incur such costs and expenses shall be responsible therefor <br />and such costs and expenses shall become an assessment against <br />such Owner's or Occupant's House. <br /> <br /> Section 14.5 Liability for Owners' and Occupants' Acts. All <br /> <br />Owners and Occupants shall be liable for the expense of any <br /> <br />maintenance, repair or replacement rendered necessary by their <br />willful acts or negligence, or by that of their guests, but only <br />to the extent that such expense is not met by the proceeds of <br />insurance carried by the Association or such Owner or Occupant. <br /> <br /> ARTICLE XV <br /> <br /> GENER~ PROVISIONS <br /> <br /> Section 15.1 Duration.
