15 Hinutes CASE #2: REQUEST FOR CONDITIONAL USE PERHIT TO KEEP A HORSE ON A PARCEL OF LESS THAN THREE ACRES; CASE OF KKo ROBERT I~ASHUGA By~ Anne Norris, Conmun£ty DeveloFment Director Background: Mr. Robert Mashuga is requesting a conditional use permit to keep a horse on a parcel of less than three acres. Mr. Mashuga is currently keeping one horse on his property at 8411 - 163rd Avenue NW. Mr. Mashuga's property is approximately one acre in size. Section 110.072 of the City Code requires a minimum of three acres for each horse maintained. In addition, Section 170.016A of the City Code requires that accessory buildings housing animals must be at least 75 feet from neighboring properties. Enclosed are the following items for your information: a) Application b) Site location map c) Revised site plan d) Section 110.07 of the City Code regarding horses e) Petition in favor of Mr. Mashuga's request f) Memo from Mr. Bretton Gates in opposition to Mr. Mashuga's request g) Proposed findings of fact h) Proposed conditional use permit Observations: The Planning and Zoning Commission conducted a public hearing on Mr. Mashuga's request on June 2, 1987. On July 7, 1987, the Commission recommended approval of Mr. Mashuga's request. From the site plan submitted, it appears that the structure housing the horse 'is approximately 27 feet from the neighboring property. Recommendation: Council Action: Motion to: Adopt Findings of Fact 00__ a conditional use permit. relating to Mr. Robert Mashuga's request for -and- Motion to: Approve/deny Mr. Robert Mashuga's request for a conditional use permit to keep a horse on less than three acres.
