15 Hinutes CASE #2: <br /> <br /> REQUEST FOR CONDITIONAL USE PERHIT TO KEEP A <br /> HORSE ON A PARCEL OF LESS THAN THREE ACRES; <br /> CASE OF KKo ROBERT I~ASHUGA <br />By~ Anne Norris, Conmun£ty DeveloFment Director <br /> <br />Background: <br /> <br />Mr. Robert Mashuga is requesting a conditional use permit to keep a horse on a <br />parcel of less than three acres. Mr. Mashuga is currently keeping one horse on <br />his property at 8411 - 163rd Avenue NW. Mr. Mashuga's property is <br />approximately one acre in size. Section 110.072 of the City Code requires a <br />minimum of three acres for each horse maintained. In addition, Section <br />170.016A of the City Code requires that accessory buildings housing animals <br />must be at least 75 feet from neighboring properties. <br /> <br />Enclosed are the following items for your information: <br /> <br />a) Application <br />b) Site location map <br />c) Revised site plan <br />d) Section 110.07 of the City Code regarding horses <br />e) Petition in favor of Mr. Mashuga's request <br />f) Memo from Mr. Bretton Gates in opposition to Mr. Mashuga's request <br />g) Proposed findings of fact <br />h) Proposed conditional use permit <br /> <br />Observations: <br /> <br />The Planning and Zoning Commission conducted a public hearing on Mr. Mashuga's <br />request on June 2, 1987. On July 7, 1987, the Commission recommended approval <br />of Mr. Mashuga's request. <br /> <br />From the site plan submitted, it appears that the structure housing the horse <br />'is approximately 27 feet from the neighboring property. <br /> <br />Recommendation: <br /> <br />Council Action: <br /> <br />Motion to: <br />Adopt Findings of Fact 00__ <br />a conditional use permit. <br /> <br />relating to Mr. Robert Mashuga's request for <br /> <br />-and- <br /> <br />Motion to: <br />Approve/deny Mr. Robert Mashuga's request for a conditional use permit to <br />keep a horse on less than three acres. <br /> <br />Review Checklist: <br /> <br />Administrator <br />Attorney <br />Engineer <br />Community Development Director <br /> <br />Chief of Police <br />Finance Officer <br />Public Works Superintendent <br />Planning and Zoning Commission X <br /> <br /> <br />
