- 2 - <br />is and shall be held, transferred, sold, conveyed, used and <br />occupied subject to the covenants, conditions, restrictions, <br />easements, charges and liens hereinafter set forth. <br />ARTICLE I <br />DEFINITIONS <br />Section 1.1 The following words, when used in this <br />Declaration (unless the context shall prohibit), shall have the <br />following meanings: <br />a. "Association" shall mean and refer to Pineview Estates <br />2nd Addition Association, Inc., a nonprofit corporation <br />created by Declarant under the laws of the State of <br />Minnesota for the purpose of administering and enforcing <br />on behalf of the Owners the covenants and restrictions <br />contained in this Declaration. <br />b. "Commerical Industrial Area" shall mean that portion of <br />the lot used to conduct business. <br />C. "Common Expenses" shall mean and include (i) all <br />expenses approved or incurred by the Board of Directors <br />or by officers of the Association, pursuant to authority <br />granted by the governing Documents or by law, in the <br />performance of their powers and duties and (ii) those <br />items identified as Common Expenses in the Declaration <br />and Association's Bylaws. <br />d. "Common Driveway" shall mean and refer to the five (5) <br />200 foot long and 30 foot wide driveways, the center <br />line of each driveway being the common lot line between <br />Lots 1 and 2; 3 and 4; 5 and 6; 7 and 8; and 9 and 10. <br />The Common Driveway as defined herein shall be for the <br />joint use and enjoyment by only the Owners on whose Lot <br />the driveway is located. The Common Driveway shall not <br />be for the use and enjoyment of any other Lot Owners. <br />e. "Declarant" shall mean and refer to Menkveld Co., a <br />Minnesota corporation, its successors and assigns, if <br />such successors and assigns should acquire any <br />undeveloped portions of the Property from the Declarant <br />for the purpose of Development. <br />f. "First Mortgagee" shall mean and refer to any person <br />named as a mortgagee under any mortgage against a lot, <br />which mortgage is first in priority upon foreclosure to <br />all other mortgages against said lot, or any successors <br />
