- 8 - <br />and shall be subject to City of Ramsey Building Permit <br />requirements. <br />g. In the event of damage to the Common Driveway caused by <br />the willful or negligent act of an Owner or Occupant, or <br />their guests, the Association shall have the right to <br />restore the Common Driveway to its prior condition and <br />assess the cost thereof against the Owner who violates, <br />or whose lessees or guests violate, such provisions, and <br />such cost shall become a lien upon the Owner's Lot and <br />shall be due and payable upon demand. <br />h. The entire lot shall remain in the control and ownership <br />of one party unless a lot split is approved by the City <br />of Ramsey. The northern 200 feet of each lot shall be <br />used exclusively for residential use only and the <br />remainder of the lot shall be used exclusively for <br />industrial/commercial uses only. <br />i. Prior to receiving a certificate of occupancy for an <br />industrial/commercial use there shall be planted three <br />(3) rows of coniferous trees between the residential and <br />industrial/commercial use on each lot, the trees being <br />planted so as to be a maximum of 12 feet apart. Lot <br />owners shall be responsible for the perpetual care, <br />maintenance and replacement, if necessary, of all <br />landscaping and screening required herein, as well as <br />any landscaping which may be required as part of the <br />site plan review procees for the industrial/commerical <br />uses required by the City of Ramsey. In the event, <br />because of seasonal weather conditions, planting cannot <br />be made when the Certificate of Occupancy is issued, the <br />Lot Owner shall deposit with the City of Ramsey, a cash <br />escrow or letter of credit equal to 125% of the City of <br />Ramsey Engineer's estimated cost of the improvement to <br />guarantee that the plantings will be completed when <br />weather conditions permit. The escrow will be returned <br />when the plantings have been accepted by the City of <br />Ramsey, or in the event the plantings are not completed <br />in a reasonable time, the City may use the escrowed <br />funds to accomplish the task. <br />j. No part of any lot shall be used or maintained as a <br />dumping ground for rubbish, trash, garbage, or other <br />waste. Garbage, rubbish and trash shall be stored only <br />in sanitary containers. <br />k. No noxious or offensive activity shall be carried on <br />upon any part of a lot nor shall any activity be carried <br />on any part of a lot which would be deemed to be an <br />annoyance or nuisance to the public. <br />1. The industrial/commercial uses shall be limted to the <br />following: <br />
