D�flFF- <br />DEVELOPMENT AGREEMENT <br />CITY OF RAMSEY <br />ANOKA COUNTY, MINNESOTA <br />PINEVIEW ESTATES 2ND ADDITION PLANNED UNIT DEVELOPMENT <br />Development Agreement by and between the City of Ramsey, Minnesota <br />(City) and The Menkveld Company, a corporation organized under the laws of <br />the State of Minnesota (Developer). <br />WITNESSETH: <br />WHEREAS, Developer is the owner of certain real property situated in <br />Anoka County, Minnesota, located in the City of Rasmey, the legal <br />description of which property is as follows: <br />The South 636.00 feet of the North 669.00 feet of the West 1650.00 <br />feet of the North Half of the Northeast Quarter of Section 28, <br />Township 32, Range 25, Anoka County, Minnesota. <br />WHEREAS, the name of the proposed Planned Unit Development is Pineview. <br />Estates 2nd Addition, hereinafter referred to as "P.U.D."; and <br />WHEREAS, Developer desires to effect the recording of the P.U.D. with <br />the Anoka County Recorder, upon the execution and approval thereof by the <br />city. <br />NOW, THEREFORE, in consideration of the mutual covenants and promises <br />contained herein, it is agreed as follows: <br />1. THE PROJECT. The parties acknowledge that the P.U.D. is <br />submitted pursuant to the City Code of the City and specifically submitted <br />pursuant to the planned unit development section of said Code. The parties <br />further acknowledge that the P.U.D. incorporates single family residential <br />uses with home occupations in Lots I through 10, Block 1. <br />2. IMPROVEMENTS. Public improvements to be incorporated and <br />constructed in conjunction with the P.U.D. include drainage easements as <br />required by the City Engineer. The Developer shall be responsible for the <br />expense associated with the construction of these improvements. The <br />locations of drainage easements shall be as shown on the attached plat <br />drawing, which plat is attached hereto as Exhibit "A". <br />3. PARKLAND DEDICATION FEE. The Developer shall pay the City's <br />required park dedication fee in accordance with the current City Code <br />requirements. <br />4. RESTRICTIVE COVENANTS. Contemporaneously with and immediately <br />following the recording of the plat, and other documents of conveyance as <br />contemplated by this instrument, Developer shall execute and cause to be <br />recorded restrictive covenants in a form and manner identical to Exhibit <br />"B" hereto attached. The restrictive covenants shall be subject to <br />approval by the City. <br />
