CASE 5:

~A~ND~NT TO ZONING ORDINANCE REGARDING ACCESSORY BUILDINGS,

ACCESSORY USES (Par. 170.014B City Code J and BLIGHT AND
NUISANCE ORDINANCE:

Listed below is the article sent to the City Council for
their review at their August 28, 1978 meeting. They are
asking for your comments, recommendations, etc. to be sub-
mitted back to the Council as required in accordance with
170.019B subparagraph 2 of the City Code in order fha% a
public hearing date can be set.

The City Staff was directed to review and make recommend-
ations to the City Council on Home Occupation and Accessory
Use as the enfo~.cemen~ of it as contained in the present City
ordinance:

Findings: The enforcement/control of home occupations is
satisfactorily covered by the present City Code (Par. 170.014E
City Zoning Ordinance). However, we do recommend an amend-
ment to the present City Code in regards to paragraph 170.014B
Assessory Uses of the Zoning Ordinance. We recommend the
following amendment to Zoning Ordinance, "Attached garage not
to be considered an accessory building. Accessory building not
to exceed 120 square feet all zoning areas and be a standard
wood frame building or steel building on a concrete foundation."

"Accessory Use shall not include the on site storage or park-
ing of trucks over one (1) ton or unlicensed equipment, loaders,
cement mixers, backhoes and similar types of construction and
excavation equipment, also including storage of inventory and
raw building material (six month grandfather of present
operators)."

Council action if they desire to amend the zoning ordinance
would be to call for public hearing in accordance with para-
graph 170.019B.

New Subject: The staff further recognizes the need for a
Nuisance and Blight Ordinance and that subdivision code should
require that all new subdivisions contain covenance that would
cover home occupations, accessory use and accessory building.
This proposed ordinance is being prepared by the City Attorney.

Please refer to enclosure (9) Building Inspectors memo on
accessory building.
