Variance Reouest- Victor Mastle}[ - <br />Mr. Mastley was present v/ith a recuest from the subdivision ordinance-' <br />to allow him to subdivide by metes and bounds a parcel owned by Bertha <br />Mae S~ith and located at the northwest corner of 166th Street and Jasper <br />Street N.W. sir. Mastley presented tv.~o plans for the parcel. One plan <br />s.~owed three lots, and one ~!an calling for two lots. After discussion <br />the consensus of the commission was to advise Mastley that the plan calling <br />for two lots was by far the more acceptable, since the other plan in- <br />dicated one lot without the required number of feet on a pNblic road. <br />A! Sorteberg stated that he would never approve the three lot split <br />by metes and bounds without a'pproved roads. <br /> <br />Motion by Art Dunn~ seconded by A1 Sorteberg to reco~.mend to the City <br />Council to grant a va. fiance to Victor Mastley to subdivide by Metes <br />and bounds to the ~arcel presently owned by Bertha Mae Smith and being <br />a part of the Southwest Quarter of the Southwes+i Quarter of Secticn 10, <br />Township 32-, Range 25~ into two parcels of approximately 3.5 acrea each <br />as per certificate of survey and subject to road ease~'~ent of 33' on west <br />property line and 40' om ~or~h.property !ine~ and payment of park dedication <br />fee. Motion carried 6-0. <br /> <br />Mr. Ma.~tley was advised that the final decision would be made by Council <br />and should not. go ahead and purchase the property befor8 he has Council <br />decision. <br /> <br />Item 4. Rezoning request - Dr. T.W. Anderson <br />Dr. Tom Anderson and Dr. Roger Austin were present with a request for <br />rezoning of 5 acres located on the Northwest corner of 167th and #47 <br />from R-1 to light commercial to allow the building of a dental office. <br /> <br />Dr. Anderso~ explained that they had already talked with the Highway Dept. <br />and they posed no objections, and they had received favorable comments <br />from the neighbors in the area. It was stated that Dr. Anderson and <br />Dr. ~ustin have operated a dental clinic in Coon ~apids with a septic <br />system for lO years without any problems. As the sketch presented for <br />review left a 2.5 acre parcel undeveloped, Ken Peterson exolained that <br />he wasn't opposed to the coocept of the dental office, but would like to <br />see a plan for the entire acreage. Dr. Anderson said that they did not want <br />to i~vest any more than necessary unless there is rezoning. There was <br />~iscussion of how the 2.5. acre parcel on #47 could be zoned so as to <br />orevent undesireable development at a future date. It was explained that <br />~he~'wou~d Iike to have the entire parcel rezoned from R-1 so as not to <br />close the door on the future. <br /> <br />The possiblity of resDrictive covenants was discussed and a Public Hearing <br />will be held on August 21. Soil borings and elevations were requested for <br />the <br /> <br />Item 5. Acceotance of Maffnesium as City Street <br />This street is located south of Industrial Blvd, ~nd west of the Mersey <br />Terrance Plat. The property owners are prepared to dedicate all the <br />necessary road right-of-ways~ and has indicated they would be v.~lling <br /> <br /> <br />
