Minnesota Environmental Quality Board Letter Dated July 24, 1980 Regarding
Ramsey'S Critical Area Plan

Chairman Peterson noted that since the receiving of the EQB letter, there hasn't
been anything done regarding the 2~ acre lot size, which the letter indicated was
inconsistent with the Critical Area Designation Order.

6. Pondvale Estates -'Preliminary'Plat Approval

Ben Deemer said due to a prevailing legal problem, they decided to plan this
in stages and they took out the outlot and made it Lot'7, Block 2.

City Engineer Raatikka asked if they were going to put in a turnaround on
150th.

Ben Deemer said they were hoping they wouldn't have to put in a turnaround there.
He said they were allowing an easement for a snoWPlower to turnaround however.

Gerald Zimmerman said there still must be a dedicated street there.

City Engineer Raatikka said a drainage easement would have to be provided there.
Ben Deemer said they would dedicate the street as an easement for the time being.

Motion by Chairman Peterson'and seconded by Ben Deemer to recommend to City
Council preliminary plat approval of Pondvale Estates and to recommend that:

a) No further public hearing be held.
b) A temporary cul-de-sac be put on 150th Lane.
c) There be a drainage easement off 150th Lane.
d) Ail plans be submitted to City Engineer Raatikka for approval.

The reason this should be granted is because of legal and financial difficulties
which forced the developers to do this in phases.

Ron West asked if there would be a problem in the future if the legal problem
didn't get resolved.

Ben Deemer said if that happened, they would just go to Phase 2.

Ron West said that he could see that the legal problem would eventually get
resolved, but it would just take time.

Motion carried 5-0. Ben Deemer abstained.

P & Z Regular Meeting Page 5 8/4/80
