Mr. Hunt was present. <br /> <br />Motion by Councilmember Cox and seoonded by Councilmember Reimann to approve <br />Mr. Harold Hunt's request for a metes and bounds subdivision of a 200' x 870' <br />parcel in the northwest quarter of the southeast quarter of Section 3, Township <br />32, Range 25. <br /> <br />Further Discussion: Counciln~r Cox noted that generally metes and bounds <br />subdivisions are not acceptable but this is an unusual situation. <br /> <br />Motion carried. Voting No: None. <br /> <br />Request For Temporary_Conditions] Use Pe ~r~dt For Grading And Excavation: <br />Case Of Waste Mmnao~m~nt Of Minnesota Inc.: <br /> <br />Mr. Den Otter and Mr. Yerq7 Miller were present. <br /> <br />Ymyor Heitman ir~uired as to when grading and excavation would commence. <br /> <br />Mr. Otter replied that activity would begin in the Spring of 1986. <br /> <br />blnyor Heitman stated that based on the fact that activity is not scheduled to <br />begin until spring and t~be pending incor~ration of a special use permit in the <br />City's recodification, he would like to see Council rescind the temporary <br />conditional use permit and pursue a special use permit to be used in' this case. <br />Mayor Heitman stated that the reasoning behind his suggestion, is that with a <br />special use permit the permitted use is tied to the landowner rather than to <br />the land itself. <br /> <br />Mr. Otter stated tiqat he believes Waste Management is already restricted to <br />~hat a special use permit would do in the conditions that have been set fort/~ <br />on the t~mporary conditional use permit. <br /> <br />Mr. Goodrich noted that %~i~ the t~porary conditional use permit Waste <br />[~nag~ment would have the right to sell excavation rights along with the <br />property, should Waste Ymnagement decide to sell ti~.e property. <br /> <br />f.~yor Heir,an stated that be prefers that the grading and excavation be granted <br />by way of a special use permit because in his mind only 2 of the 4 <br /> ~rlue~lm for <br /> November 26, 1985 <br /> <br />Page 9 of i~ <br /> <br /> <br />
