t~npcrary conditional use permits are satisfied and those same criteria do not
apply as specifically in a special use permit; the bonus is that the use would
be tied to the property owner rather than to the property itsalf.

Mr. Otter inquired if the City is considering requesting that all other
excavation permits in Ramsey be by special use permit.

Mayor Heitman replied that the special use permit is a part of the proposed
recodification and there is a concurrence on the part of Council that
recodification will be approved.

Mr. Otter inquired if he would have to go through a hearing process again if he
changed his request to a special use permit.

l,!r. If the tenporary conditional use permit is denied he
will apply for a special use permit.

Mr. Goodrich stated that he believes Mr. Otter would agree to language being
written into the permit agreement that would tie the use to the owener rather
than the property.

Councilrm~nber Schlueter noted that s'ne voted negatively to the findings of
fact and te,.i~rary conditional use permit and is obligated to vote 'no' to the
permit agre~i,ent.

Mr. Goodrich stated that there has been past discussions regarding trespassers
accessing the subject property from the north to dump garbage and the fact that
the applicant should have that access restricted; after some researc/q it has
been determined that the area of properS: in question does not belong to Waste
~na 9emen t.

~otion by Councilmember Cox and seconded ~j~ Councilm~=nber Scrteberg to adopt
the temporary conditional use permit agreement for Waste Management of
Mir~nesota, Inc. as reviewed at this Council meeting of Nov~:ber 26, 1985 and to
autJ~orize the Mayor and Acting City Aclninistrator/Clerk to execute the same
upon payment by the applicant of the temporary conditional use pe.rmit fees.

Further Discussion: Mayor Heitm~n irquired as to' what assurance ~be City has
that final grade elevations will be maintained as it is stated they will be
maintained. Mr. Otter replied stated that ar~nua!.~ topography r,~ps are prepared
and they will be submitted to the City for review. Mayor Heiu-~,~n incuired if
compaction after excavation will ~mtch tine current compaction levels.
Otter rep!Jed that the to,oil will be looser but within a short period of time
compaction will reach it's origir~al state.
