-9- <br /> <br />date of the adoption of this ordinance, who does not conform to the <br />provisions of this ordinance shall be given 30 days to comply or submit <br />applicalion for the necessary variances. <br /> <br />110.189 ENFORCEMENT <br /> <br />Subdivision 1. Impoundment, In addition to the penalties imposed <br />in lJO.lgS~ a person in violation o:[ this ordiancne may be subject to <br />having the wild animals in question impounded~ or destroyed, Owners <br />in violation of this ordinance will have ten days to correct the viola- <br />lion and redeem a wild animal. Tile owner is responsible for all costs <br />incurred by the City to capture, keep and/or destro), a wild animal. <br />Ifa wild animal is not redeemed, the City will dispose of such wild <br />animal in an), manner it deems necessary such as (but not limited <br />to) selling, destro),ing, or donating to an appropriate organization <br />or agency. <br /> <br />Subdivision 2. Rabies,. A wild animal capable of transmitting rabies <br />which has been known to have bitten a person shall be quarantined <br />and observed for rabies under the direction of a licensed veterinarian <br />for a period o~ time and in ~acilities determined to be adequate by <br />that veterinarian and the City. If a wild animal is proven to be rabid, <br />the wild animal shall be destroyed. If a wild animal is proven ~o not <br />be rabid by a licensed veterinarian, it will be returned to the owner. <br /> <br />Subdivision 3. Enforcement Authority. Enforcement o~iicers shall <br />have the right to destro), a wild animal posing an immediate threat <br />of serious harm to an), person, livestock or house pet. <br /> <br />ll0.1gl0 PENALTY <br /> <br />A person who fails to comply with or violates provisions o~ the ordi- <br />nance or the restrictions of a conditional use ?,m~, wild animal <br />license or variance sna.~ be subiec: ~o a fine o£ not more than ~700 <br />~or each day when the violation persists and/or imprisonment <br />~ ~eriod no: exceeding 9~ days, or maximum penalty allowed bF law, <br />such fine and imprisonment being pursuan~ :o ~he provisions of ~' <br />soza S~z~uze Chapter 3~5.
