PROPOSED FINDINGS OF FACT <br />COMMERCIAL ASPHALT COMPANY <br /> <br />I. That Commercial Asphalt Company, hereinafter referred to as "Applicant" <br />has properly applied for a conditional use permit to construct and operate <br />a commercial asphalt bituminous plant in the I-1 Industrial district. <br /> <br />2. That the Applicant appeared before the Ramsey Planning and Zoning <br />Commission for a public hearing pursuant to Section 170.013D of the Ramsey <br />City Code on September 1, 1987 and that said public hearing was properly <br />advertised and that the minutes of said public hearing are hereby <br />incorporated by reference. <br /> <br />3. That the subject property is legally described as follows: <br /> <br />The most southeasterly 20 acre parcel of the following described <br />property: <br /> <br />Lot 3, AUDITORS SUBDIVISION NUMBER 30, according to the map or plat <br />thereof on file and of record in the office of the County Recorder in <br />and for Anoka County, Minnesota. <br /> <br />-and- <br /> <br />Lot 1, AUDITORS SUBDIVISION NUMBER 31, according to the map or plat <br />thereof on file and of record in the office of the County Recorder in <br />and for Anoka County, Minnesota. <br /> <br />-and- <br /> <br />The West 995 feet, as measured at right angles, of the South Half of <br />the Southeast Quarter of Section 27, Township 32, Range 25, Anoka <br />County, Minnesota except that part taken for Industry Avenue <br />Northwest as shown on Anoka County Highway Right-of-Way Plat No. 8. <br /> <br />The East Half of the Southeast Quarter of the Southwest Quarter of <br />Section 27, Township 32, Range 25, Anoka County, Minnesota, except <br />that part thereof described as follows: <br /> <br />Commencing at the Northwest corner of said East Half 'of the <br />Southeast Quarter of the Southwest Quarter; thence South along <br />the West line of the said East Half of the Souteast Quarter of <br />the Southeast Quarter 409.44 feet to the point of beginning; <br />thence East at right angles 11 feet; thence South at right angles <br />264 feet; thence West at right angles to the West line of said <br />East Half of the Southeast Quarter of the Southwest Quarter; <br />thence north along said West line to the point of beginning. <br /> <br />-and- <br /> <br />Lot 3, AUDITORS SUBDIVISION A~UMBER 31, according to the map or plat <br />thereof on file and of record in the office of the County Recorder in <br />and for Anoka County, Minnesota exceotin~ therefrom the tract <br />described as follows: <br /> <br />Beginning at th~_- Southwest corner of said Lot 3; thence <br />southeasterly along the southerly line of said Lot 3 a distance <br /> <br /> <br />
