Voting No: None. <br /> <br />Motion by Councitmember Cox and seconded by Councilmember DeLuca <br />authorizing City Staff to draft a resolution establishing a policy that <br />will indicate it is not the responsibility of Ramsey's contracted <br />vendors to provide professional services to the general public unless prior <br />authorization is obtained from the City Administrator and/or City Council. <br /> <br />Further Discussion: Councilmember DeLuca stated that the policy should <br />also establish whether or not it is the responsibility of staff to <br />determine if petitions for referendums submitted are in proper legal form. <br />Councilmember Cox stated that making sure a petition is in property legal <br />form is the responsibility of those persons submitting it. City Attorney <br />Goodrich created a scenario of a petition not in proper legal form being <br />submitted on the final day of the 30 day waiting period and inquired if the <br />citizens have lost their opportunity for referendum because the 30 days has <br />run out and there isn't time to redo the petition correctly. Councilmember <br />Cox stated that it is the responsibility of persons creating tile petition <br />to have it reviewed by their own legal counsel to make sure it complies <br />wi~h Charter requirements. Mr. Hartley noted that the policy should also <br />specify standard professional services that are provided by the city. <br />Councilmember Cox stated that there are also many issues that the City <br />Administrator has direction over and the city's budget makes it clear that <br />great amounts of his time cannot be expended on explanations that are <br />really the responsibility of the citizen to research . <br /> <br />Motion carried. Voting No : None. <br /> <br />Case f~5: Sewer And Water A!i~nmcn~ Options South Of U.S. Highway <br /> <br />Mr. Raatikka stated that pursuant to Council direction, he has researched <br />options for the sewer and water project south of Hwy. ~10. Those options <br />are: !) place sewer and water in the Hwy. #10 right-of-way which will <br />require obtaining a new permit, submitting new plans and surveys and <br />obtaining temporary easements; 2) cut down on easement widths over the <br />existing alignment to decrease right-of-way costs but forego MSA funds <br />because the easement would not be adequate to accommodate a State aid <br />street; 3) reduce temporary easements by 40 feet on the original plan to <br />reduce costs slightly; 4) stop the projec: completely. <br /> <br />Councilmem~zer Pearson stated that he feels property owners may be more <br />receptive to easement negotiations at this time because the>' are beginning <br />to realize that the best situation is to align sewer and water in the <br />frontage road right-of-way rather than have to pay for laterals beir~g <br />extended from Hwy. ~10.
