The City Council hereby authorizes the establishment of a <br />Horseman's Council to receive complaints from those aggrieved by <br />horse owners or keepers, to investigate complaints, to advise <br />horsemen against whom complaints have been lodged and to advise <br />t~e Ci[y Council to appropriate action. <br /> <br />The City Council shall select five persons to the Horseman's <br />Council, including when possible, a representative of all local <br />horse-oriented association or club and a veterinarian. Each <br />member will serve a two-year term and is eligible for <br />reappointment at the end of that term. <br /> <br />The Horsemanfs Council shall recommend approval or disapproval to <br />the City Council of all requests under this ordinance for <br />variances. <br /> <br />hrUISANCE <br /> <br />No person, firm or corporation shall keep any horse, colt or pony <br />in such a manner deemed to be a public or private nuisance by the <br />Horse Council. <br /> <br />ENFORCEMENT OF ORDINANCE <br /> <br />Any person, firm or corporation failing to comply with the <br />provisions of this ordinance shall be guilty of a misdemeanor and <br />may be punished with a maximum fine of $300.00, niney days in <br />jail or both. <br /> <br />SEPARABILITY <br /> <br />If any section, subsection, sentence, clause or phrase of this <br />ordinance is, for any reason, held to be invalid, such decision <br />shall not affect the validity of the remaining portions of the <br />ordinance. The City Council declares that it would have passed <br />this ordinance and each section, subsection, sentence, clause or <br />phrase irrespective of the fact that any one or more sections, <br />subsections, sentences, clauses or phrases be declared <br />unconstitutional. <br /> <br />3 <br /> <br /> <br />
