filing of such appeal, no further action shall be taken until <br />the matter has been heard. Upon receipt of the request, the <br />City Manager shall place the matter before the Council at its <br />next regular meeting. The o~ner may appear with counsel if <br />he chooses, and present evidence in opposition to the order. <br />Following such hearing the.Council shall make a determination <br />of facts and shall, based ~upon such determination, affirm, <br />repeal, or modify the Chief's order. The Council shall also <br />establish a'date for compliance with the order as affirmed, <br />or modified, which date shall be not less than five (5) days <br />thereafter. Upon expiration of the time limit, the dog <br />catcher shall abate the nuisance. <br /> <br /> Insurance Required. For a period of two (2) years <br />~-fter having been ordered to abate any nuisance pursuant to <br />this Chapter, such person shall not keep, maintain, nor <br />harbor a dog or cat nor permit any member of his household to <br />keep, maintain, or harbor a dog or cat unless he files with <br />the City Clerk evidence of insurance coverage for personal <br />injury and property damage from dogs or cats in the amounts <br />of $10,000.00 per person; $5,000.00 property damage; and <br />$25,000.00 per incident. <br /> <br /> Failure to Restrain an attack by an Animal. It <br />shall be unlawful ~or an owner to fail to restrain an animal <br />from inflicting or attempting to inflict bodily injury to any <br />person or other animal. Violation of this section shall be a <br />misdemeanor. The Court upon a finding of the defendant's <br />guilt hereunder, is authorized to order, as part of the <br />disposition of the case, that the animal be destroyed based <br />on a written order containing one or more of the following <br />findings of fact: <br /> <br />The animal is dangerous as demonstrated by a vicious <br />attack, an unprovoked attack, an attack without warning, <br />or multiple attacks; or <br /> <br />The owner of the animal has demonstrated an inability <br />or unwillingness to control the animal in order to <br />prevent injury to persons or other animal. <br /> <br />If the Court does not order the destruction of the dog, the <br />Court shall, as an alternative, order the defendant to <br />provide, and show proof to the Court of public liability <br />insurance in the minimum amount of $300,000.00. <br /> <br /> Destruction of Dangerous A~nimals. The Chief of <br />Police or his designate shall have the authority to order <br />the destruction of dangerous animals. An animal is <br />considered dangerous after it has: <br /> <br />Caused serious bodliy injury or disfigurement to any <br />person; or <br /> <br /> <br />
