Engaged in any attack on any person under circumstances <br />which would indicate danger to personal safety of a <br />person; or <br /> <br />3. Bitten one or more persons on two or more occasions; or <br /> <br />Exhibited unusally aggressive behavior, such as an <br />unprovoked attack on another animal. <br /> <br /> Procedure. The Police Chief or his designate <br />after having b~en advised of the existence of a dangerous <br />animal shall proceed as follows: <br /> <br />The Police Chief, or his designate, shall notify the <br />owner or keeper of the animal, by registered mail, that <br />the animal appears to be dangerous. The notice shall <br />specify the dates, times, places and parties bitten. <br />Said notice shall also apprise the owner or keeper that <br />he may request a hearing before the City Council by <br />filing an appeal with the City Manaager within ten (10) <br />days after the receipt thereof. <br /> <br />If no owner requests a hearing within ten (10) days of <br />said notice, the Police Chief shall authorize and direct <br />the Animal Control Officer to capture and immediately <br />dispose of the animal. The owner or keeper of the <br />animal shall immediately make the animal available to <br />the Animal Control Officer, and failure to do so shall' <br />be a misdemeanor. <br /> <br /> Appeals. If an owner requests a hearing for <br />~etermination as to the dangerous nature of the animal, the <br />City Manager shall place the matter before the City Council <br />at its next regular meeting. The owner may appear with <br />counsel if he chooses, and present evidence in opposition the <br />designation of the animal as dangerous. Following the <br />hearing the Council shall make a determination of facts and <br />shall make such order as it deems proper. The Council may <br />order the Animal Control Officer to take the animal into <br />custody for destruction. If the animal is ordered into <br />custody for destruction, the owner shall immediately make the <br />animal available to the Animal Control Officer and failure to <br />do so shall be a misdemeanor. <br /> <br /> Harbo~in~ a Dangerous Animal. Any oerson who <br />harbors an anima~ azter it has been found by t~e Council to <br />be dangerous and ordered into custody for destruction shall <br />be guilty of a misdemeanor· <br /> <br /> Stoooing an Attack. If any Police Officer or <br />;~nimal Control Officer is witness to an attack by an animal <br />upon a person or another animal, the officer may take <br />whatever means he cr she deems appropriate to bring the <br />attaak to an end and prevent further injury to the victim. <br /> <br /> <br />
