Motion by Councilmember Cox and seconded by Councilmember Sorteberg to <br />adopt the alternate alignment which connects Dysprosium Street NW to County <br />Road No. 5 at approximately a 90 degree ~ngle and authorize the City <br />Engineer to prepare a right-of-way plan in accordance with MSA street <br />standards. <br /> <br />Motion carried. Voting Yes: Mayor Reimann, Councilmembers Sorteberg, Cox, <br />DeLuca and Pearson. Voting No: None. <br /> <br />Case ~2: Request For Conditional Use Permit To Keep A Horse Ob A <br /> Parcel Of Less._Th~n Three Acres; Case Of Mr. Robert Mashu~a: <br /> <br />Councilmember Pearson stated he received a call from a Bernice Tenquist at <br />7751 150th Lane and she is opposed to the Mashuga's request'to keep a horse <br />on less than 3 acres. <br /> <br />Councilmember Cox noted that horses were once allowed on one acre parcels <br />but a considerable amount of complaints and problems arose; Council amended <br />the ordinance to the 3 acre requirement. <br /> <br />Motion by Councilmember Cox and seconded by Councilmember Sorteberg to <br />adopt Findings of Fact 0174 relating to Mr. Robert Mashuga's request for a <br />conditional use permit. (Refer to findings of fact file for Findings of <br />Fact 0174). <br /> <br />Further Discussion: Mary Luoma - 16313 Marmoset - Stated that the <br />~shuga's submitted a petition, signed by 9 persons, favoring their request <br />and challenged the identity of the last signature on the petition. Mrs. <br />Mashuga stated that the last name on the petition is a lady that lives <br />on Cry. Rd. #5 that signed the petition as an interested party. Mrs. Luoma <br />stated that she has letters from persons who signed the petition favoring <br />the request indicating that they are no longer in favor of the request; she <br />also presented a petition from neighboring property owners that oppose the <br />request to keep a horse on less than 3 acres. Council received the <br />petition. Councilmember Cox noted that the Mashuga's are to be respected <br />for their efforts to approach this situation in the proper legal manner but <br />there is considerable objection to the request. Councilmember DeLuca noted <br />that the City of Dayton requires 5 acres to keep a horse.
