use permit and Mn/Dot licensing of a personal use heliport. She indicated the highlights of the <br />conditional use permit criteria and terms would include the following: <br /> <br />A. A minimum parcel size of 10 acres; <br />B. Acceptable noise levels in accordance with Minnesota Rules; <br />C. Aircraft operator is licensed; <br />I). Written permission of property owner for a heliport when the applicant does not <br /> own the property; <br />l:';. City authority to determine if the use will unduly endanger persons or property; <br />F. l,anding pads must be surfaced with bituminous or concrete; <br />G. City authority to establish permitted hours of operation; <br />lt. The applicant must provide proof of liability insurance; <br />I. Pre-existing uses must comply with the new regulations. <br /> <br />Community Development Director Frolik stated that requiring Mn/Dot licensing also puts into <br />effect FAA review. <br /> <br />Commission Input <br /> <br />Chairperson Nixt asked where the Staff extracted the draft of this ordinance. <br /> <br />Colnlnunity Development Director Frolik stated Ham Lake is the only one that comes to mind <br />right now. <br /> <br />Colnmissioner Brauer asked why they would allow them at all. <br /> <br />Community Development Director Frolik stated because of the rural area to the north the City <br />Council thought there were some situations where they might be appropriate. <br /> <br />Chairperson Nixt stated he can see that is how Staff reached the recommendation of ten acres <br />along with FAA licensing of the pad to give the City reasonable control. However, where there <br />is one home built on the east of their lot and the neighboring home built on the west end of their <br />lot, the homes are no further away than those built on two and a half acre lots, and this poses a <br />problem. <br /> <br />Community Development Director Frolik stated that is where Staff hopes the FAA would say it <br />is not appropriate. <br /> <br />Commissioner Brauer asked if condition E would address those issues, which says 'City <br />authority to determine if the use will unduly endanger persons or property'. <br /> <br />Chairperson Nixt asked where Staff came up with the liability insurance minimum and <br />maximum.
