Motion by Chairperson Nixt, seconded by Commissioner Jeffrey to recommend that City Council <br />approve the request for an Interim Use Permit to place temporary classroom buildings on the <br />P.A.C.T. Charter School site until October 15, 2004 and adopt a resolution declaring the terms of <br />the permit, with the following additional conditions: <br /> <br />1. That not less than 130 parking stalls are available on improved streets or a combination of <br /> improved streets and a temporary parking surface finished with Class 5 materials. <br />2. That a partial occupancy permit be received from the City Building Inspector for access to <br /> the portions of the premises described in the applicant's materials. <br /> <br />Motion carried. Voting Yes: Chairperson Nixt, Commissioners Jeffrey, and Shepherd. Voting <br />No: None. Absent: Commissioners Johnson, Van Scoy and Watson. Commissioner Brauer <br />abstained. <br /> <br />Case #3: <br /> <br />Public Hearing - Request for Comprehensive Plan Amendment; Case of <br />Patrick Fitzpatrick <br /> <br />Presentation <br /> <br />Assistant Community Development Director Trudgeon further advised the subject property was <br />designated comlnercial in the Comprehensive Plan and zoning map prior to the adoption of the <br />2001 Comprehensive Plan. The 2001 Comprehensive Plan now shows the property located at <br />9150 }lighway 10 as Low Density Residential. Patrick Fitzpatrick resides on the subject property <br />and recently became aware of the parcel's residential land use designation. He indicated Mr. <br />Fitzpatrick does not agree with the residential designation and is requesting a comprehensive <br />plan amendment to change the land use designation from Low Density Residential to Places to <br />Shop. <br /> <br />Assistant Community Development Director Trudgeon noted that the City Council has expressed <br />that they want this property to remain residential, and Staff has received three letters opposed to <br />the rczoning request. <br /> <br />Citizen Input <br /> <br />Pat Fitzpatrick stated he is asking for mixed use, not just B-2. He indicated he has aerial photos <br />that show how this lays out. He stated since filling out the application he has spoken with a <br />realtor and believes mixed use is the best zoning. He indicated the letters of opposition say they <br />do not want a business there, and he can understand that. He commented the owner at 9340 <br />wanted mixed use and was granted it and not charged for the change. He stated he is asking for <br />thc same thing. <br /> <br />Assistant Community Development Director Trudgeon noted for a mixed use PUD, there is not <br />enough acreage on this parcel so it would have to be B-2. <br /> <br />Planning Commission/May 6, 2004 <br /> Page 7 of 22 <br /> <br /> <br />
