5. FIRE LANES Fire lanes shall be maintained on the Site The exact location of the fire <br /> lanes on the Site shall be as directed by the City's Fire Chief <br /> 6. LIGHTING. Any lighting installed on the structure or in the parking lot is subject to the <br /> prior approval of the City Engineer and shall be designed so as to deflect light away from <br /> all adjacent parcels Bulbs emitting in excess of 3,000 lumens (150 watts) shall be so <br /> directed that the bulb is not visible from off of the property where such light source is <br /> located <br /> 7. BUILDING FACADE. The Permittee agrees to construct all building faces of the same <br /> material as listed on the Building Elevations Plan prepared by Lampert Architects, dated <br /> June 8, 2004 , revision dated , 2004 <br /> 8. STORMWATER MANAGEMENT FEE. The Stormwater Management Fee shall be <br /> due at the closing of the sale of the Development Property to the Permittee <br /> 9. REQUIREMENTS FOR BUILDING PERMIT.No building permit for the Site will be <br /> issued until the Permittee has a) signed and returned this Development Permit, and b) <br /> provided the City with a copy of the LRRWMO permits c) provided the City with a <br /> revised site plan in accordance with improvements approved by the City Counci No <br /> Certificate of Occupancy for the Structure will be issued until the Required <br /> Improvements, or a financial surety for same, are accepted by the City <br /> 10. IMPROVEMENT CONSTRUCTION SCHEDULE. The Required Improvements <br /> shall be constructed and completed before July 15, 2005 <br /> 11. RECOGNITION OF LOCATION. The Permittee agrees to recognize the City of <br /> Ramsey as the City of location on all of its forms of advertising and business <br /> correspondence whenever reasonably prudent to do so. <br /> 12. INSPECTION FEES. The Permittee shall be responsible for all inspection costs <br /> incurred by the City related to the installation of the Required Improvements The <br /> Permittee shall make a cash deposit into the appropriate escrow account of the City and <br /> the City shall have the authority to draw upon these funds for the purpose of <br /> compensating fot inspection services The amount of the deposit shall be equal to five <br /> percent (5%) of the estimated cost of the Required Improvements, which equates to Three <br /> Thousand Three Hundred Fifty Dollars and no Cents ($3,350 00) This escrow amount <br /> shall provide surety for the cost of constructing storm sewer and parking lot <br /> improvements Upon completion of the required Improvements to the satisfaction of the <br /> City, any surplus balance remaining in the City's escrow account shall be refunded to the <br /> Permittee <br /> 13. FINANCIAL ASSISTANCE. The City shall be responsible to provide the financial <br /> assistance listed in Section 2 2 of the Development Agreement between the parties hereto <br /> dated June 23, 2004 The payment for the Site Improvements shall be made at the time a <br /> Certificate of Occupancy for the Development Property is issued These payments will <br /> be made to Permittee only if all property taxes, City fees and charges on the property are <br /> current <br /> 31 <br />
