Police Chief Katers stated that sometimes there are updates to State or U.S. Supreme Court <br /> Rulings and stated that the department asked for those updates and those have been provided. <br /> He stated that the City also receives one on one work with officers when they must testify in <br /> court. He stated that a majority of the cases are resolved prior to trial and they do seek the input <br /> of the department when needed. He stated that there are also some prosecutions regarding <br /> community development, such as ordinance violations, and the prosecutor's office provides <br /> service for those laborious cases as well. <br /> Councilmember Kuzma asked if the City has a set prosecutor or whether multiple attorneys <br /> handle the caseload. <br /> Police Chief Katers stated that the contract is through the firm and does not list a specific <br /> attorney, noting that based upon availability sometimes the firm has contracted with another firm <br /> to provide service. He advised that the City has not seen any change in the level of service <br /> received. He noted that if a case is going to trial, a more experienced litigator will handle the <br /> case. <br /> Councilmember Shryock stated that the City has had a lengthy history with this firm and asked <br /> why the City is not interested in obtaining a three-year contract at this time rather than just a one- <br /> year extension. <br /> Police Chief Katers stated that this would allow the City to stagger the dates and allow the City <br /> to go through the RFP process the next year, rather than going through that process for both the <br /> civil and criminal attorneys as those are split between different firms. He stated that in this case <br /> the three-year mark has been hit and would recommend a one-year extension, then going out for <br /> an RFP next year before the contract expires to determine if the City is receiving the best <br /> available services. <br /> City Administrator Ulrich stated that the rates are satisfactory and are probably on the low end <br /> and service is also satisfactory. <br /> Councilmember Johns stated that this proposal seems to make sense as it would allow that <br /> additional time. <br /> Acting Mayor LeTourneau asked the purpose of going out for RFP next July and stated that <br /> perhaps the City is comfortable with the level of service and rate and extend the contract out for <br /> three years, going through RFP at that time. <br /> Councilmember Shryock agreed that if the City is satisfied with the service and price she would <br /> also agree with extending the contract out two to three years, which would still create that <br /> stagger. <br /> Councilmember Kuzma stated that he has no problem testing the waters through RFP, as it keeps <br /> people honest. <br /> City Council Work Session /July 26, 2016 <br /> Page 2 of 6 <br />
