CC Regular Session 4.4. <br /> Meeting Date: 07/26/2016 <br /> Submitted For: Jo Thieling,Administrative Services <br /> By: Jo Thieling,Administrative Services <br /> Information <br /> Title <br /> Approve Declining a Portion of Property Located at 15931 Xenon Street NW <br /> Purpose/Background: <br /> Purpose: To approve declining a strip of property located at 15931 Xenon Street NW. <br /> Background: Staff was notified that the City of Ramsey was willed(with restrictions)a piece of property located at <br /> 15931 Xenon Street NW. The property owner was Dora Nallick and her will states the following: <br /> "I give and devise the property described as Lots 2,the severed right triangle of 2A, 3 and 3A,Block 1,Nature <br /> View Addition,to the City of Ramsey,Minnesota; provided,however,that said real property shall be subject to the <br /> following covenant: <br /> Lots 2, the severed right triangle of Lot 2A, 3, 3A,Block 1,Nature View Addition, shall remain,in perpetuity,as <br /> wildlife habitat with no development,commercial or residential, and said real property shall remain"as is"with no <br /> clearing of vegetation or other activity which departs from the said property's natural state." <br /> A copy of the plat is attached. <br /> Parks staff reviewed the property to determine a need that would fit within the restrictions of the will. It was noted <br /> the parcel is parallel to an existing trail corridor, and appears to include wetland,with high ground nearer the street. <br /> Mr. Riverblood determined that the strip of land would most likely be of greatest value to the adjoining simgle <br /> family home; and not of great value of or use by the City. <br /> Engineering staff also reviewed the property to determine a need that would fit within the restrictions of the will. <br /> Mr. Westby stated that the subject property could provide approximately 50,000 cubic yards of fill material for use <br /> in developing The COR,which will require several hundred thousand cubic yards of fill to develop. Additionally, <br /> about two acres of the parcel could be converted to wetland,which the City could then bank for future wetland <br /> mitigation purposes. It was noted that this process would be disrupting the property so it appears to not meet the <br /> intent of the will, and therefore, serves no useful purpose to the City. <br /> Staff has received a signature request on a disclaimer re the property from the attorney representing the Nallick <br /> Estate. The disclaimer states that the City of Ramsey, irrevocably and without qualification renounces,releases, <br /> declines,disclaims and refuses to accept any and all rights or interest in and to the described property. <br /> Finding no public purpose that falls within the restrictions of the will, staff is requesting Council approve the <br /> disclaimer and authorize City Administrator Ulrich to sign same on behalf of the City of Ramsey. <br /> Recommendation: <br /> Staff is recommending City Council approve disclaimer to the property and authorize City Administrator Ulrich to <br /> sign the disclaimer on behalf of the City of Ramsey, as it relates to the strip of property located at 15931 Xenon <br /> Street NW,Ramsey,Minnesota. <br /> Action: <br />
