l)arks/Utilities Supervisor Riverblood explained it would be constructed with posts, rather than <br />as a floating structure. There would likely be securing posts out to the deck, which may hinge so <br />it can fluctuate. <br /> <br />Chairperson Elvig inquired if there have been any reports of kids jumping off of these types of <br />structures. <br /> <br />Councilmember Zimmerman suggested other cities be investigated to determine if there are <br />histories of accidents with these types of structures. <br /> <br />Councihnember Strolnmen stated she has seen these structures in a lot of parks. This wetland <br />has a lot o£ bird life and it would be great to be able to get closer. There certainly are older kids <br />that would go on the trail, but there are not usually a lot of young kids on their own. <br /> <br />I'm'ks/Utilities Supervisor Riverblood indicated he is not aware of any concern with fishing piers. <br />The water depth here would likely be about 18 inches to a maximum of 30 inches. He is not <br />awarc o 1' any specific liability that municipalities should be aware of with fishing piers. <br /> <br />Chairperson Elvig stated he thinks this would be a great amenity that he could see people using a <br />lot, and this neighborhood is very receptive to wilderness in the area. He suggested there be <br />signage to discourage jumping or walking on the handrails. He stated he is in favor of this and <br />clarified there are funds available. <br /> <br />Parks/Utilities Supervisor Riverblood indicated the funds are available. The Ponds subdivision <br />contributed more than $75,000 into the Park Trust Fund, and this project is estimated at $9,000. <br /> <br />Councilmcmber Zimmennan asked if there is a contractor lined up that would do the project for <br />the $9,000 amount. <br /> <br />l>arks/Utilities Supervisor Riverblood replied he is confident it can be done for the $9,000 <br />amount. Specifications still need to be drawn up and vendors have not been contacted yet. <br /> <br />Motion by Councihnember Strom~nen, seconded by Councilmember Zimmerman, to recommend <br />thc City Council authorize staff to proceed with construction of an observation pier within <br />Flintwood Terrace Park, at a not-to-exceed amount of $9,000. <br /> <br />Motion carried. Voting Yes: <br />Zimmcrman. Voting No: None. <br /> <br />Chairperson Elvig, and Councilmembers Strommen and <br /> <br />Case #3: <br /> <br />Quarterly Review of Franchise Fee Collections <br /> <br />l';inancc Officer Lund reviewed that in October 2003, City Council adopted franchise fee <br />ordinances with Centerpoint Energy and Connexus Energy. Section 5 of this ordinance stated <br />that thc City Council will review these ordinances at the first meeting irnmediately following the <br />City's collection of the fi'anchise fee revenue of the applicable quarter.
