The city then'exercised their right, of <br />eminent domain and served us with condemnation papers to <br />prove to us they were dead'serious about the construction <br />of this road. <br /> <br />Because of this condemnation by the city, we accepted the <br />fact that the road was going to be constructed and in good <br />faith worked with the city engineer to be sure the location <br />of the road would be okay. We have incurred considerable <br />expense in doing this. <br /> <br />On the other hand, city has .not acted in good faith. They <br />have submitted no firm offer to us even though they had an <br />appraisal made of the property, instead the city requested <br />that we donate the property for the road. When we said this <br />was unacceptable, the city then threatened to take steps <br />that would force us to donate it. <br /> <br />We believe these unethical tactics by the city to punish the <br />land o~ners for not accepting an offer the city'never made in <br />the first place is arbitrary and capricious. <br /> <br />We are consulting an attorney to find out what our legal <br /> ~hos are in this si~ -~' <br />r~ ~ ~ ~u~.~lor~. <br /> <br />Edward & Lore Hamilton <br /> <br />cc: City Administrator, David Hart!ey. <br /> City Attorney, William .Goodrich <br /> City Engineer, Peter Raatikka <br /> <br /> <br />
