CASE #2: <br /> <br />REQUEST FOR CONDITIONAL USE PEP, MIT TO KEEP A HORSE ON A PARCEL <br /> OF LESS THAN THREE ACRES; CASE OF MI{. ROBERT MASHUGA <br /> By: Community Development Director Anne Norris <br /> <br />Background: <br /> <br />Mr. Robert Mashuga is requesting a conditional use permit to keep a horse <br />on a parcel of less than 3 acres. Mr. Mashuga is currently keeping one <br />horse on his property at 8411 163rd Avenue N.W. Mr. Mashuga's property is <br />approximately one acre in size. Section 110.072 of the City Code requires <br />a minimum of 3 acres for each horse maintained. In addition, Section <br />170.016A of the City Code requires that accessory buildings housing animals <br />must be at least 75 feet from neighboring properties. <br /> <br />For your information, the following items are enclosed: <br /> <br />a) Application <br />b) Site location map <br />c) Revised site plan <br /> d) Section 110.07 of the City Code regarding horses <br /> e) Proposed findings of fact <br /> f) Proposed conditional use permit <br /> <br />Ob servat ions: <br /> <br />The Planning and Zoning Commission conducted a public hearing on Mr. <br />Mashuga's request on June 2, 1987. At that time, the Commission tabled <br />action on Mr. Mashuga's request until Mr. Mashuga could submit a revised <br />site plan. <br /> <br />From the revised site plan submitted, it appears that the structure housing <br />the horse is approximately 27 feet from the neighboring property. <br /> <br />Recommendation: <br /> <br />Commission Action: <br /> <br />Motion to: <br />Recommend adoption of findings of fact relating to Mr. Robert <br />Mashuga's request for a conditional use permit. <br /> <br />-and- <br /> <br />Motion to: <br />Recommend approval/denial of Mr. Robert Mashuga's request for a <br />conditional use permit to keep a horse on less than 3 acres. <br /> <br />Review Checklist: <br /> <br />Administrator <br />Attorney <br />Engineer <br />Community Development Director <br /> <br />Chief of Police <br />Finance Officer <br />Public Works Superintendent <br />Other <br /> <br /> <br />
