3. No legally impounded animal shall be released except to <br />tile person displaying a receipt from the city clerk showing payment in <br />full of the costs of impounding and care of the animal. If any person, <br />without authority of law, and without first paying the costs due, shall <br />take any impounded animal out of the enclosure in which he is impounded, <br />he shall be guilty of a misdemeanor. <br /> <br /> 4. Costs incurred by the city in impounding horses r~nning <br />at large shall be paid by the owner of the horse prior to releasing said <br />animal. <br /> <br /> 5. If any horse impounded is not redeemed within fot~rteen <br />(la) days, the chief of police or his designated agent shall give an <br />additional three (3) days notice of the time and place where such animal <br />or animals will be sold by posting and serving notices as required for <br />notice herein. If such animal cannot be sold on the day stated, it may <br />be sold as soon as possible thereafter without notice. <br /> <br /> 6. The city clerk shall turn over the proceeds of any sale <br />to the city treasurer. On order of the city council, the city treasurer <br />sl~all pay to the o~ner of such animal the difference between the sale <br />price as stated in item a, after deducting the cost of impounding, feed- <br />ing and sales charges, if the owner makes claim for the monies within <br />one (1) year from tile date of the sale; otherwise, it shall be forfeited <br />to the city. <br /> <br /> 7. No person may ride or drive a horse after the hour of sun- <br />set and before the hour of sunrise along or crossing any public way <br />without appropriate lighting or reflectorized clothing. <br /> <br /> 8. No person may ride or drive a horse in any public park, <br />beach, golf course or other public property except within the right-of- <br />way of public streets and highways and in areas duly designated as a <br />trail way or hitching area. <br /> <br /> 9. The city park and recreation commission shall designate <br />and properly post those areas in public lands and parks where horses <br />.~ay be ridden. <br /> <br /> 10. Every person riding a horse or driving any horse-drawn <br />vehicle upon a public roadway shall be subject to those provisions of <br />the city code applicable to the driver of a motor vehicle, except those <br />provisions which by their nature have no application. <br /> <br /> 11. No horse shall be ridden or driven in any manner which <br />would cause undue damage to any hard-surfaced road. <br /> <br /> 12. No person shall ride or drive any horse upon private <br />property without the prior wirtten permission of the owner or occupant <br />thereof. <br /> <br /> 13. No person or domestic animal shall interfere with any <br />horse ridden or kept in a lawful manner. <br /> <br /> <br />
