PROPOSED FINDINGS OF FACT <br /> CONDITIONAL USE PERMIT <br /> MR. ROBERT MASEUGA <br /> 8411 163RD AVENUE N.W. <br /> <br />1) <br /> <br />That Mr. Robert Mashuga, hereinafter referred to as "Applicant", has <br />properly applied for a conditional use permit to keep a horse on a <br />parcel less than 3 acres. <br /> <br />That the Applicant appeared before the Planning and Zoning Commission <br />for a public hearing pursuant to Section 170.013D of the City Code on <br />June 2, 1987 and that said public hearing was properly advertised and <br />that the minutes of that public hearing are hereby incorporated by <br />reference. <br /> <br />3) That the subject property is generally known as 8411 163rd Avenue N.W. <br /> and is legally described as follows: <br /> <br />Lot 1, Block 4, Woodlawn Estates, Anoka County, Minnesota <br /> <br />4) That the subject property is approximately one acre in size. <br /> <br />5) That the subject property is located in the R-iR Residential District. <br /> <br />6) That Section 110.07 of the City Code requires that there be at least <br /> three acres for each horse maintained on a parcel. <br /> <br />7) <br /> <br />That Section 170.016A of the City Code states that all accessory <br />buildings housing animals are required to be at least 75 feet from <br />neighboring property lines. <br /> <br />8) That the adjoining properties are zoned R-iR Residential and are <br /> occupied by residential structures. <br /> <br />9) That keeping a horse on the subject property will not be unduly <br /> dangerous to persons residing in the area. <br /> <br />10) That keeping a horse on the subject property may attract flies and <br /> create unpleasant odors in the area and if so, will impair the <br /> enjoyment of surrounding properties. <br /> <br />11) That keeping a horse on the subject property is not contrary to the <br /> specific objectives of the Comprehensive Plan. <br /> <br />12) That keeping a horse on the subject property will be maintained so as <br /> to be appropriate in appearance with the character of the area. <br /> <br />13) That keeping a horse on the subject property may create nuisances such <br /> as flies and odors and if so, will be disturbing to neighboring <br /> properties. <br /> <br />14) That keeping a horse on the subject property will not create excessive <br /> additional requirements at public cost for public facilities. <br /> <br />15) That the proposed use will be adequately served by essential public <br /> facilities and services. <br /> <br /> <br />
