Inc.~. <br /> <br />(~airman Peterson noted that DNR has requested that the City table any <br />action ~ this request in order that they may have more time to review the <br />impacts of the manmade lake ~n Lake Itasca. The Commission should proceed <br />to review the case so that the developers will know any other areas that <br />need additional attention. <br /> <br />T~e Cc~mission proceeded to review the proposed findings of fact. <br /> <br />Commissioner Zimmerman inquired if any deep soil borings have been <br />performed in the proposed location for the lake and if a liner is being <br />considered for the lake. Cxmm~issioner Zi~merman noted an instance where <br />the County excavated beyond the clay liner into gravel; all the water fr~ <br />the lake drained out ar~ the result was a ~amp. What are the consequences <br />if this excavation goes into granular soils? <br /> <br />Mr. Rehbein - Stated that if clay is encountered during excavation, <br />excavation will cease. The project is engineered so that the water table <br />of the mar~ lake will stay constant with Lake Itasca. The only way the <br />water can be lost is if <br /> <br />Mr. ~ehbein replied that the project will be excavating through granular <br />materials all the way; the proble~ arises when you pass through clay and <br />proceed into granular material again; if this excavation hits clay, <br />excavation will stop. <br /> <br />Cc~missioners Zi~merman and ~-ner requested that deeper soil borings be <br />performed to prove that the excavation process will not lower the water <br />table in the area. <br /> <br />Mr. Peck stated that the City Engineer was supplied with all the data he <br />felt would be necessary; request that the Commission be specific about <br />additional information requested and who will be reviewing it. <br /> <br />CommissiOner Deemer replied that what is required is in the mining <br />ordinance, which is the same as the State's. <br /> <br />Ms. Norris stated that the City Engineer interpreted this project as <br />grading and excavating needing a conditional use permit. <br /> <br />Ommukssi~er Deemer stated that removal of more than 200 yards of earth <br />fr~m a site requires a mining permit.
