Mr. Peck inquired if maybe the excavation for drainage purposes and <br />excavation for creation of lake should be addressed as two sepa£te items <br /> <br />in orde= to provide for drainage needs as soon as poss/ble. <br /> <br />Chairman Peterson replied that if the City ~gineer feels requirements for <br />a drainage area are met, the developers can proceed with the necessary <br />excavatic~ and continue to pursue the conditional use permit for additional <br />excavation required for the lake creation. <br /> <br />Chairman Peterson and Omm~issioners Deemer and Zi~meman stated that they <br /> <br />have no problem with the creation of the lake after environmental questions <br />are answered. <br /> <br />Cxznissioners Hemlriksen and Shum~ay stated that they do not recall that <br />the P.U.D. was to include a manmade lake; there was discussion of Lake <br />Itasca being a private lake; request that this proposal be referred back to <br />Parks and Recreation Cxmmdssion for their review. C~issi~r Hendriksen <br />stated that he is not in favor of the creation of a mam~ade lake and in his <br />opinion, the excavation for dra/nage and lake creation should be pursued as <br />one permit. Ccmmissi~r ~_ndri~ stated a $7500 bo~d is inadequate for <br />a project of this ma~nit~. <br /> <br />Mr. Rehbein noted that the $7500 is to cover anything beyond the 5 acres <br />that the developer might have open at any one time, which would be in <br />violation of the permit. <br /> <br />Chairman Peterson suggested that the required bond amount be reviewed again <br />by City Engineer Raatikka. <br /> <br />Oam~issi~r Deemer expressed concern for the additi~ml wear and tear to <br />MSA route 153rd by the heavy truck traffic. <br /> <br />Chairman Peterson suggested that the City Engineer also review the impact <br />of expediting normal wear and tear to 153rd by heavy truck traffic. <br /> <br />Commi~si~er Ztamerman requested confirmation from the City Engineer that <br />the excavation process will not lower the water table in the area and the <br />liability incurred by the City if that should happen. <br /> <br />C(mmdssioner ~endriksen stated that there should be a limit placed on the <br />amount of material that can be stockpiled at any one time. <br /> <br />Chairman Peterson requested an opinion from City Attorney Goodrich <br />regarding concerns for safety factors expressed by citizens and any <br />liability incurred by the City. <br /> <br />Motion by <br />table L&G <br />create a <br />requested <br /> <br />Om~issioner Deemer and seconded by Commissioner Zimmerman to <br />Behbein's request for a conditional use permit to excavate and <br />manmade lake in the Northfork P.U.D. until all information <br />has been sutmitted to and reviewed by City Staff. <br /> <br />Motion carried. Voting Yes: Chairman Peterson, Commissioners Deemer, <br />Shu~ay, Zi~erman, ,e_ndriksen, r~nue and Howell.
