Voting No.' None. <br /> <br />~ l~_Dort Frc~ City Attorney R~_arding X-R~t~ Vi~o~: <br /> <br />Mr. Goodrich reported that according to State law, cities cannot be <br />involved in detertmining what is obscene and what is not. If there are <br />concerns about ~bscene literature and movies, they can be handled through <br />the State or County attorney. In certain instances, city attorneys can <br />prosecute if it is determined there was something obscene as determined <br />m~[r~State law. Anything dealing with distribution of obscene materials to <br />rs is an autcmatic felony. It appears that U.S. Constitution and State <br />law will allow cities to adopt ordinances that say X rated videos, <br />magazines and other related materials, shall be maintained by the retailer <br />in a rocm or separate area reasonably inaccessible to persons under 18 <br />y~ars of age and that distribution of X rated materials to a minor is an <br />auta~atic misdemeanor. <br /> <br />Councilmembers Cox ar~ DeLuca stated that they would be in favor cf such an <br />ordinance. <br /> <br />Mayor Reimann directed City Attorney Goodrich to contact the local <br />suppliers of VfR videos to determine their anticipated cooperation with <br />such an ordinance and obtain their input and suggestions for better <br />controls. <br /> <br />Councilmember DeLuca inquired if the ordinance can also include those R <br />rated materials with X rated packaging. <br /> <br />Mr. Goodrich replied that he will draft an ordinance for council <br />consideration and the key language will be 'harmful to minors'. <br /> <br />~ l~view Policy_ On Charging_ For Fire And P~scue Ca~]-~: <br /> <br />Mayor Reimann stated with council's position of going ahead with a fire <br />department in l~m~ey, may it is time to _make adjustments to the Policy of <br />charging citizens for fire calls. <br /> <br />Councilmember Defmca stated that considering the amount cf problems created <br />by charging citizens for fire calls, he believes it would be better if the <br />City did pay the fire call bills. [tis only concern with the City paying <br />the fire calls would be for a prevision for eha~ persons for prank and <br />intentional false alarms. ~ 3 ~- 37 <br /> <br />Mr. Goodrich stated that prank and intentional false alarms are addressed <br />in State statutes. <br /> <br />Finance Officer Graczyk reoam,anded that if the policy of charging fire <br />calls to the benefitting parties is changed, it be retroactive to December <br />31, 1986. Mr. Graczyk stated that the /Accounting Department barely has the <br />time to do the initial fire billing and has no time to follow up with <br />second and third collection notices. <br /> <br />Council tabled any action until the next regular Council meeting. <br /> <br />Page 19 of 21 <br /> <br /> <br />
