C~pliance~ In order to assure compliance wi~h ~he performance standards set forth above, the City Council may require the owner or operator of any pe~itted use to make such [nvestiSat[ons and tests as may be required to show adherence to above per- formance s~andards. Such investigation and ~ests as are required ~o be made shall be carried out by an independent test[n~ or,an[ration as may be asreed upon by the City and the owner or operator, or if there failure to aEree within ~en days after written notice by the City to the ~ner or operator to ~e such ~at[on and tests, by such independent testin~ or,an[ra- tion as may be selected by the Council. The costs cuffed in hav~ such [nvestisat[ons or tests conducted shall be borne entirely by the owner or operator. The procedure s~a~ed above shall not preclude the City from ~akins any such other tests and investigations finds appropriate to dateline compliance with these perfo~ance standards. All costs incurred by the City in processing an application for a site plan review shall be paid by the applicant. Said costs shall include but not be limited to: professional consulting services as directed by the Planning Commission and/or City Council, copying charges, extraordinary City staff involvement, public hearing publications, and written notice to adjacent property ovners. A set fee established from time to time by the City Council shall be deposited vith the City at the time the application is made. At the time the application is made, if the Zoning Officer determines that costs in addition to the set fee will likely be incurred by the City, then an additional sum as determined by the Zoning Officer shall be deposited vith the City. Any portion of those funds deposited but not expended shall be returned to the applicant after final action on the application.
