Such investigation and ~ests as <br /> are required ~o be made shall be carried out by an <br /> independent test[n~ or,an[ration as may be asreed upon <br /> by the City and the owner or operator, or if there <br /> failure to aEree within ~en days after written notice <br /> by the City to the ~ner or operator to ~e such <br /> ~at[on and tests, by such independent testin~ or,an[ra- <br /> tion as may be selected by the Council. The costs <br /> cuffed in hav~ such [nvestisat[ons or tests conducted <br /> shall be borne entirely by the owner or operator. The <br /> procedure s~a~ed above shall not preclude the City from <br /> ~akins any such other tests and investigations <br /> finds appropriate to dateline compliance with these <br /> perfo~ance standards. <br /> <br />All costs incurred by the City in processing an application for a <br />site plan review shall be paid by the applicant. Said costs <br />shall include but not be limited to: professional consulting <br />services as directed by the Planning Commission and/or City <br />Council, copying charges, extraordinary City staff involvement, <br />public hearing publications, and written notice to adjacent <br />property ovners. A set fee established from time to time by the <br />City Council shall be deposited vith the City at the time the <br />application is made. At the time the application is made, if the <br />Zoning Officer determines that costs in addition to the set fee <br />will likely be incurred by the City, then an additional sum as <br />determined by the Zoning Officer shall be deposited vith the <br />City. Any portion of those funds deposited but not expended <br />shall be returned to the applicant after final action on the <br />application. <br /> <br /> <br />
