On March __~ 1987 a conditional use ~e~mit was issued to L. & G. Rehbein Inc. for the grading and excavation of filL1 in the Northfork P.U.D. ~he property to be graded and excavated is located south of 161st Avenue N.W. and west of Andrie St=eet N.W. The intent of the grading and excavating is to create a man- ~ lake with approximately 40 acres of surface area and an average depth of 25 feet. This grading and excavating permit shall apply to that property legally described as follows: That part of Outlot C of Northfork located in the South Half of Section 18 and the North Half of Section 19, Township 32, Range 25, Anoka County, Minnesota, except that area located on the east side of ~'~c~ie Street. This permit is issued pursuant to Section 170.013D of the P~_m~ey City Code. This conditional use permit is perpetual in its duration so long as the conditions imposed herein are complied with. The conditions of this permit are as foll(~s: mo A phasing plan and restoration plan shall be provided and followed to minimize wind and water erosion of the site and which plan shall not allow for more than five acres of shoreline to be exposed at any one time. ~e five acres of exposed area shall be exclusive of the beach area and water surface. Said plans are attached hereto and incorporated herein as Exhibit A. ~estoration as used herein shall be def/ned as mean/rig grading and top soil replacement and grass seeding such that turf is established which will prevent water and wind erosion. mo No hauling shall be allowed on any residential streets including Jarvis Street and Andrie Street. Only State, County and Municipal State Aid Streets constructed to 9 t~ standarda shall be used as haul roads. 3. All final slopes shall be less than four feet horizontal to one foot vertical (4:1). The hours of the grading and excavating operation shall be limited to the following.- Monday through Saturday: 6:00 a.m. to 10:00 p.m. No more than 5 acres of shoreline area shall be graded and excavated at any one time and the r~der of the site excluding the lake and beach shall be c~e~ restored before oam~.ncing any new operations on the site. Behbein shall notify City staff for inspection of the site prior to c(~m~ancing operations in a new area ~ the site.
