Mr. Ylitalo stated that Mr. Root is not operating his business on the <br />premises at this time but wishes to retain his conditional use permit; <br />seems unusual for the City to require a bond from him under those <br />circumstance s. <br /> <br />Mr. Goodrich stated that if Mr. Root is not operating his business, then he <br />should let the permit be revoked and he won't have to post bond. <br /> <br />Mr. Ylitalo stated that Mr. Root is not seeking revocation of the permit; <br />seems unreasonable for the City to require a bond at this time when <br />construction cannot begin until spring. <br /> <br />Mr. Goodrich stated that if Mr. Root wants to operate before he paves, he <br />will have to supply the bond. <br /> <br />Mr. Ylitalo stated that under those circumstances, the City is actually <br />requiring a fee for Mr. Root to operate his business. <br /> <br />Mr. Goodrich replied that it is not a fee. <br /> <br />Mr. Ylitalo stated that it is ooercion. <br /> <br />Mr. Root stated that he doesn't know why his business is the only one in <br />the area being required to have a dustfree parking area; he has spent $7200 <br />on upgrading his parking area and many other businesses have no material at <br />all applied to their driveways. <br /> <br />Counciln~mber Cox inquired as to what Mr. Root's conditional use permit <br />requires. <br /> <br />Mr. Goodrich stated that the permit requires compliance with all city <br />requirement s. <br /> <br />Mr. Ylitalo stated that the conditional use permit specifies a lot about <br />parking but nothing about parking surfaces. <br /> <br />Councilmsmber COx agreed that the conditional use permit does not spell out <br />in depth what would be required for parking areas. <br /> <br />Mr. Goodrich stated Council options as follows: 1) Grant a variance to <br />blacktop/concrete; 2) Find that the traprock is acceptable and meets <br />durable/dustless; 3) Revoke the permit; 4) Revoke the permit and issue <br />another that more accurately defines what is required of driveway and <br />parking areas. Mr. Goodrich stated that the City's requirement is for <br />parking areas to be of a durable, dustless surface; don't know what Mr. <br />Root was told would be included in durable, dustless surfaces. <br /> <br />Councilmember Cox stated that he has not seen any indication that Mr. Root <br />was told he would be specifically required to apply blacktop or concrete. <br /> <br />Mr. Root stated that he has applied traprock at 5 other places of business; <br />it packs very well but it does take time. Traprock is more durable than <br />blacktop because it does not get potholes. ~e has ordered more traprock to <br />apply to the area. <br /> <br />Page 12 of 26 <br /> <br /> <br />
