Councilmember Cox stated that he agrees with the City Engineer that <br />traprock is not totally dustless, but not even blacktop is dustfree in this <br />sandy area; a $3500 bond is a lot to require of a small business; deviating <br />from ordinanoe with a business not in a o~mercial area is distatestful; it <br />is a burden to Council and City Attorney to hold Mr. Root to more than he <br />has. <br /> <br />Mr. Goordrich stated other issues are addressed in the ordinance like <br />lighting and noise that have to be oc~plied with even though they are not <br />specifically addressed in each permit; do agree that requirements for <br />parking and driveway areas need to be more clearly defined. Mr. Goodrich <br />also noted that there is a large pieoe of machinery on Mr. Root's property <br />which violates the oonditiona/ use permit. <br /> <br />Mr. Root stated that the machinery to which Mr. Goodrich referred is being <br />removed. <br /> <br />Motion by Councilm6~ber Cox and seconded by Councilm~mber Pearson directing <br />City Staff to draft a revised conditional use permit for Mr. Root. <br /> <br />Further Discussion: City Attorney Goodrich stated that the motion is <br />directing that a revised conditional use permit be drafted indicating that <br />traprock will suffice pursuant to what ordinance requires. Councilmember <br />Cox stated that the determination on traprock is for Mr. Root's conditional <br />use permit only and not conditional use permits in general. Mr. Goodrich <br />assumed that this motion also implies waiving of the escrow required at a <br />previous Council meeting. <br /> <br />Motion carried. Voting Yes: Mayor ReJ3na/u~, Councilm6{nbers Sorteberg, Cox, <br />DeLuca and Pearson. Voting No: None. <br /> <br />Council recessed at 8: 55 p.m. <br /> <br />Mayor Reimann called the meeting back to order at 9:10 p.m. <br /> <br />Request For Metes And Bounds Subdivision: Case Of Mr. Gerald <br /> Bauer: <br /> <br />Ms. Norris stated that Mr. Bauer is requesting a metes and bounds <br />subdivision between Lots 3 and 6, Block 10, Ford Brook Estates, in order to <br />transfer land from Lot 6 to Lot 3 as much of Lot 3 is oovered with wetlands <br />and he wants to avoid bringing in fill to make it a better buildable site. <br />Planning and Zoning Commission recommended denial of the request because it <br />would create two substandard lots. <br /> <br />Motion by Councilmember Cox and seconded by Councilmember Pearson to <br />aI~prove a 50 foot maximin metes and bounds subdivision between Lots 3 and <br />6, Block 10, Ford Brook Estates oontingent upon Mr. Gerald Bauer' s purchase <br />of these properties. <br /> <br />Further Discussion: Councilm~nber COx stated that this subdivision will <br />only be carried through if Mr. Bauer purchases the subject properties. <br />Councilm~mber DeLuca stated that he reviewed the subject property and he <br />has ooncerns with it's buildabiltiy, especially because of deep, deep <br />slopes on the property.
