These matters are within its jurisdiction <br />to decide. Although the Board has been given the power to grant variances <br />this power is limited by other conditions. These are stringent conditions <br />imposed upon the power of the Board to grant variances. <br /> <br /> The four izonditions which the Board must find present and which <br />must be sustained with evidence presented by the appellant are; <br /> <br />1. The property will not yield a reasonable return if used 'in <br /> compliance with the ordinance;. <br /> <br />The conditions causing the hardships are unique and are not <br />shared by neighboring property in the same zone; <br /> <br /> . o,t~r the char,~cter <br />The u-anlir~9 o~, the varbr~ce will not essentially -' o <br />of the neighborhood; <br /> <br />The granting of the variance will not be in conflict with the <br />Comprehensive Plan. <br /> <br /> If the appellant fails to prove only one of the conditions, the Board <br />cannot legally g~anl the variance. The burden of proof of these matters <br />rests on the applicant. He is requesting a special privilege, arid it is incumbent <br />upon him to prove that the conditions necessary for granting'of the privilege <br />are satisfied. <br /> <br /> The decision of the Bbard shall be made not later than 30 days from <br /> the dale of hearing. When a decision has been made regarding the granting <br />.'or denial of the variance, the Board must put its decision in written form <br /> and show the reasons for its actions. <br /> <br /> <br />
