DISTRICT COURT <br /> <br /> An applicant may request the District Courl to review the denial of <br />his application for a variance by the Board of Adjustment. <br /> <br /> In some cases in which the applicant has received the relief requested, <br />neighborhood property owners may believe that the grant of relief was <br />contrary to the provisions of the ordinance, or that the grant of relief, <br />even if in compliance v,'ith the provisions of the ordir, ance, ~,.'m invalid <br />b~cause it would cause a serious depreciation in their property wlues. In <br />such c~ses the ns;95~,orir,9 property o~','ners or others, includir, g tSe Board <br />of Cour, ty Comn',issions, may appe.al the decision of the E~ard of <br />Adjustment to the District Court. <br /> <br /> The action of the court will be based entirely upon the record made <br />by the Board of Adjustment. No further evidence will be heard by the <br />court. <br /> <br /> The court may affirm the action of the Board of Adjustment; it mey <br />reverse the action of the Board; or i( it concludes that the record is <br />inadequate, it may send the matter back lo the Board of Adjustment for <br />additional hearings. <br /> <br /> <br />
