Voting No: None. <br /> <br />Motion by Councilmember Cox and seconded by Councilmember DeLuca <br />authorizing City Staff to draft a resolution establishing a policy that <br />will indicate it is not the responsibility of Ramsey's contracted <br />vendors to provide professional services to the general public unless prior <br />authorization is obtained from the City Administrator and/or City Council. <br /> <br />Further Discussion: Councilmember DeLuca stated that the policy should <br />also establish whether or not it is the responsibility of staff to <br />deterT, ine if petitions for referendums submitted are in proper legal form. <br />Councilmember Cox stated that making sure a petition is in property legal <br />form is the responsibility of those persons submitting it. City Atto:':~c~y <br />Goodrigh created a scenario of a petition not in proper legal form bezng <br />submitted on the final day of the 30 day waiting period and inquired if the <br />citizens have lost their opportunity for referendum because the 30 days has <br />run out and there isn't time to redo the petition correctly. Councilmember <br />Cox stated that it is the responsibility of persons creating the petition <br />to have it reviewed by their own legal counsel to make sure it complies <br />~'ith Charter requirements. Mr. Bartley noted that the policy should also <br />specify standard professional services that are provided by t]:e city. <br />Councilmember Cox stated that there are also many issues that the City <br />Administrator has direction over and the city's budget makes it clear that <br />great amounts of his time cannot be expended on explanations that are <br />really the responsibility of the citizen to research . <br /> <br />Motion carried. %~otimg Yes: Mayor Reimann, Councilmembers Sorteberg, Cox, <br />DeLuc a and Pearson. Those options <br />are: !) place sewer and water in the Hwy. ~I0 right-of-way ~'hich will <br />require obtaining a new permit, submitting new plans and surveys and <br />obtaining temporary easements; 2) cu: down on easement ~id~hs over the <br />existing alignment to decrease right-of-way costs but forego MSA funds <br />because the easement ~...'ou].d net be adequate te accommodate a State aid <br />streez; 3]~ reduce temporary easements by 40 feet on the original plan to <br />reduce costs slightly; 4) stop ~he projec: completely. <br /> <br />Counci!mem'~ar Pearson stated that he feels property owners ~s.">,' be more <br />receptive to easement negotiatior, s az this time because they are beginning <br />to realize that ~he best situation is -~o align sewer and water in the <br />frontage road right-of-way rather than have to pay for laterals being <br />extended from Evv. ¢~!0.
