~ FI~II~S Cf' FACT <br />14707 ~ STREET N.#. <br /> <br />1. Mr. INle Me, auXin, herein referred to as 'Applicant', has properly <br />applied for a Board of Adjustment variance fr~m the side yard setback. <br /> <br />2. That the Applicant appeared before the Board of Adju~,~nt for a public <br />hearing pursuant to Section 170.013G of the City Code on February 9_6, 1987 <br />and that said public hearing was properly advertised and that the minutes <br />of said public hearing are hereby incorporated as a p~rt of these findings <br />by reference. <br /> <br />3. That the subject property is generally known as 14707 Waco Street N.W. <br />and is legally described as : <br /> <br />Lot 16, Block 6, River's Bend, Anoka County, Minnesota. <br /> <br />4. That the subject property is located in the R1-U Residential District <br />and is approximately 14,000 square feet in size. <br /> <br />5. That Section 170.016B of the City Code requires a minimum side yard <br />setback of ten (10) feet. <br /> <br />6. That on the north side of the property there is a ten (10) foot <br />drainage ea~ment ~ontaining a storm drainage pipe. <br /> <br />7. That the Applicant is proposing to oonstruct a residential structure <br />the subject property which will encroach on the required side yard on the <br />south by five (5) feet. <br /> <br />8. That the Applicant is requesting a variance of five (5) feet from the <br />required side yard setback on the south side of the subject property. <br /> <br />9. That the Applicant has stated that there are unique circumstances <br />applying to the subject property, namely, the width of the drainage <br />easement ~ the northern property boundary. <br /> <br />10. That the Applicant has stated that the variance is necessary for the <br />preservation and enjoyment of a substantial property right similar to <br />that possessed by other properties in the River's Bend plat or in the R-1U <br />Residential district. <br /> <br />11. That the special ~onditions, namely the drainage easement and pipe, do <br />not result fr~ the actions of the Applicant. <br /> <br />12. That if the variance is granted, the variance will not grant the <br />Applicant any special privilege that is denied by the Zoning Ordinance to <br />other (miners of land in the River's Bend plat or in the R-1U Residential <br />district. <br /> <br /> <br />
