REQUEST FOR VARIANCE FROM FRONT YARD SETBACK; <br /> CASE OF MR. JOHN PLOE~ER <br />By: Community Develolment Director Anne Norris <br /> <br />Background: <br /> <br />Mr. John Ploeger is requesting a variance from the front yard setback to <br />construct his home at 15640 Juniper Ridge Drive. Mr. Ploeger is requesting <br />to position his house on the lot such that there will be a 25 foot front <br />yard setback. Section 170.016A of the City Code requires a front yard <br />setback of 40 feet. Mr. Ploeger has stated that he is requesting this <br />variance in order to preserve trees on the property. <br /> <br />For your information, the following items are enclosed: <br /> <br />a) Application <br />b) Site location map <br />c) Public hearing notice <br />d) Properties notified <br /> e) Certificate of lot survey and proposed location of house <br /> f) Proposed findings of fact <br /> g) Proposed variance <br /> <br />Observations: <br /> <br />Mr. Ploeger has reviewed his request with the developers of Reilley Estates <br />and neighbors of his lot; they are not opposed to his request. <br /> <br />Recommendation: <br /> <br />The trees create a unique situation to the property; staff recommends approval <br />of Mr. Ploeger's request. <br /> <br />Board of Adjustment Action: <br /> <br />Motion to: <br />Adopt Findings of Fact relating to Mr. Ploeger's request for a <br />variance from the front yard setback. <br /> <br />-and- <br /> <br /> Motion to: <br />/denyMr. John Ploeger's for variance from the front <br /> request <br /> a <br /> yard <br /> setback. <br /> <br />Review Checklist: <br /> <br />Administrator <br />Attorney <br />Engineer <br />Community Development Director <br />DNR <br /> <br /> Chief of Police <br /> Finance Officer <br /> Public Works Superintendent <br />X Building Official X <br /> <br /> <br />
