That the Applicant has stated that there are unique conditions applying <br /> to the property in quest[on; namely, the Mississippi River and the lot <br /> size, that do not apply generally to other properties in the ~I-R <br /> District. <br /> <br />17 That the subject property was platted prior to the City's adoption of <br /> the Critical River 0verlay District standards. <br /> <br />18. That the Applicant has stated that such variance is necessary for the <br /> preservation and enjoyment of the substantial property rights similar <br /> to those possessed by other properties in the R1-R Residential <br /> District. <br /> <br />19. That the special conditions do not result fro~ the actions of the <br /> Applicant. <br /> <br />20. That if the variance is granted, the variance will not allow the <br /> Applicant any special privilege that is denied by the Zoning Ordinance <br /> to other owners of land in the R1-R Residential District. <br /> <br />21. That the Appllcant has stated that he is requesting the minimum <br /> variance to alleviate the hardship. <br /> <br />22. That the variance, ii granted, will not be materially detrimental to <br /> the purposes of the Zoning Ordinance and the Critical River 0veraly <br /> District or other property in the R1-R Residential District. <br /> <br />23.
