Chairman Zimmerman stated that he has not seen it in writing from Mr. Stine. <br /> <br />Chairman LaDue said that the Findings of Fact and the case state what Mr. <br />Stine's position is on this. <br /> <br />Commissioner Hendriksen stated that the whole rationale behind the setback <br />requirement i$ DNR regulations. Why can't we issue approval to this request <br />contingent upon DNR approval? Then we're not authorizing anything unless they <br />agree to it. <br /> <br />Chairman Zimmerman stated that every time you grant a variance you are setting <br />a precendence. <br /> <br />Motion failed. Voting Yes: Commissioners Peterson and Howell. Voting No: <br />Chairman Zimmerman, Commissioners LaDue and Hendriksen. Abstained: None. <br />Absent: Commissioners Shumway and Holm. <br /> <br />Motion by Commissioner Hendriksen and seconded by Commissioner LaDue to approve <br />Mr. Kiecker's request for a variance from the required Mississippi River <br />setback amended as follows: <br /> <br />Add Item #6: <br /> <br />That the applicant will provide a site plan that has been <br />approved by the DNR prior to the issuance of a building <br />permit by the City of Ramsey. <br /> <br />Further discussion: <br /> <br />Chairman Zimmerman stated that he still wants to see something in writing from <br />the DNR. <br /> <br />Motion failed. Voting Yes: Commissioners LaDue and Hendriksen. Voting No: <br />Chairman Zimmerman and Peterson. Abstained: Commissioner Howell. Absent: <br />Commissioners Shumway and Holm. <br /> <br />Motion by Chairman Zimmerman and seconded by Commissioner Peterson to table <br />Mr. Kiecker's request for a variance from the required Mississippi River <br />setback to allow additional time for written response from Mr. John Stine of <br />the DNR. <br /> <br />Further discussion: <br /> <br />Commissioner Howell also requests that the DNR provide information on the 100 <br />year and 500 year flood levels and what anticipated erosion is expected in that <br />area. <br /> <br />Motion carried. Voting Yes: <br />Howell, LaDue and Hendriksen. <br />Commissioners Shumway and Holm. <br /> <br />Chairman Zimmerman, Commissioners Peterson, <br />Voting No: None. Abstained: None. Absent: <br /> <br />Case #2: Request for Variance from the Required Front Yard Setback; Case <br /> pf Mr. John Ploeger: <br /> <br />The Board proceeded to review the proposed findings of fact. <br /> <br />Motion by Commissioner Peterson and seconded by Commissioner LaDue to adopt <br />Findings of Fact #0161 relating to Mr. John Ploeger's request for a variance <br />from the required front yard setback. <br /> <br /> <br />
