Commissioner Peterson moved the adoption of the following findings of fact: <br /> <br />FINDINGS OF FACT ~0160 <br /> }fR. RICHARD KIECKER <br /> <br />That Mr. Richard Kiecker, hereinafter referred to as "Applicant", has <br />properly applied for Board of Adjustment variance from the Mississippi <br />River setback. <br /> <br />That the Applicant appeared before the Board of Adjustment for a public <br />hearing pursuant to Sections 170.013G and 170.0112G of the City Code on <br />April 30, 1987 and that said public hearing was properly advertised and <br />the minutes of said public hearing are hereby incorporated as part of <br />these findings by reference. <br /> <br />3. That the subject property is generally known as 14700 Bowers Drive N.W. <br /> and is legally described as follows: <br /> <br />Lot 10, Bowers Mississippi Acres, Anoka County, Minnesota <br /> <br />4. That the subject property is located in the R1-R Rural Residential <br /> District. <br /> <br />5. That the subject property is located in the Critical River Overlay <br /> District. <br /> <br />6. That the subject property is approximately one acre in size. <br /> <br />That Section 170.0112G of the City Code requires a minimum setback from <br />the Mississippi River of 200 feet from the ordinary high water mark. <br /> <br />8. That the Applicant is proposing to construct a 20 foot addition to his <br /> existing house. <br /> <br />9. That the existing structure is set back approximately 105 feet from the <br /> Mississippi River. <br /> <br />10. That the existing house encroaches on the river setback by <br /> approximately 95 feet. <br /> <br />11. That the Applicant is requesting to further encroach on that by an <br /> additional 20 feet. <br /> <br />12. That the Applicant's variance request requires DNR approval due to its <br /> location in the Critical River Overlay District. <br /> <br />13. That Mr. John Stine, DNR, has reviewed the Applicant's proposal and has <br /> stated that if the addition encroaches on the river setback similar to <br /> that of adjacent structures, he has no objection to the Applicant's <br /> request. <br /> <br />14. That an adjacent structure to the southeast of the Applicant's lot is <br /> set back approximately 135 feet from the Mississippi River. <br /> <br />15. That an adjacent structure to the northwest of the Applicant's lot is <br /> set back approximately 95 feet from the Mississippi River. <br /> <br /> <br />
