16. That the Applicant has stated that there are unique conditions applying <br /> to the property in question; namely, the Mississippi River and the lot <br /> size, that do not apply generally to other properties in the <br /> District. <br /> <br />17 That the subject property was platted prior to the City's adoption of <br /> the Critical River Overlay District standards. <br /> <br />18. That the Applicant has stated that such variance is necessary for the <br /> preservation and enjoyment of the substantial property rights similar <br /> to those possessed by other properties in the R1-R Residential <br /> District. <br /> <br />19. That the special conditions do not result from the actions of the <br /> Applicant. <br /> <br />20. That if the variance is granted, the variance will not allow the <br /> Applicant any special privilege that is denied by the Zoning Ordinance <br /> to other owners of land in the RI-R Residential District. <br /> <br />21. That the Applicant has stated that he is requesting the minimum <br /> variance to alleviate the hardship. <br /> <br />22. That the variance, if granted, will not be materially detrimental to <br /> the purposes of the Zoning Ordinance and the Critical River Overaly <br /> District or other property in the R1-R Residential District. <br /> <br />23. That the variance will not increase the congestion of public streets or <br /> substantially impair property values within the neighborhood. <br /> <br />The motion for the adoption of the foregoing findings of fact was duly <br />seconded by ~ommissioner Hendriksen and upon vote being taken thereon, the <br />following voted in favor thereof: <br /> <br /> Chairman Zimmerman <br /> Commissioner Hendriksen <br /> Commissioner Howell <br /> Commissioner LaDue <br /> Commissioner Peterson <br /> <br />and the following voted against the same: <br /> <br /> None <br /> <br />and the following abstained: <br /> <br /> None <br /> <br />and the following were absent: <br /> <br /> Commissioner Holm <br /> Commissioner Shumway <br /> <br />whereupon said findings of fact were declared duly adopted by the Ramsey <br />Board of Adjustment this the 30th day of April, 1987. <br /> <br />-2 - <br /> <br /> <br />
