Absent: Commissioner <br /> <br />BOARD OF ADJUST~...ENT BUSINESS <br /> <br />Request For Variance From Mississippi River Setback~ Case Of <br /> Mr, Richard Kiecker: <br /> <br />Mr. and Mrs. Richard Kiecker were present regarding their request for a <br />variance from the Mississippi River setback. The findings of fact relating <br />to the Kiecker case were adopted April 30, 1987. Further action was tabled <br />pending review of the request by John Stine of DNR. <br /> <br />Motion by Commissioner LaDue and seconded by Commissioner Hendriksen to <br />approve Mr. Kiecker's request for a variance from the Mississippi River <br />setback. <br /> <br />Further Discussion: Ms. Norris reported that John Stine of DNR has <br />determined that the property is above the 100 year flood plain. <br /> <br />Motion carried. Voting Yes: <br />Holm, LaDue and Hendriksen. <br />Howell.' <br /> <br />Chairman Zimmerman, Commissioners Shumway, <br />Voting No: None. Absent: Commissioner <br /> <br />Case ~2; <br /> <br />Request For Variance From Section 170.015G Of The City Code <br /> TQ Construct A GaraEe Nearer Front Lot Line Than The Principal <br /> Structure: Case Of Michael And Helen McCurry; <br /> <br />Michael and Helen McCurry were present. Mr. McCurry stated that he is <br />requesting a variance to construct a garage nearer the front lot line than <br />the principal structure. The existing garage will be converted to living <br />space. The proposed location of the new garage is the only flat, dry area <br />left on his parcel. The home on the lot was not built facing the road but <br />rather turned to one side; the wet area and home placement only leave one <br />feasible place on the lot on which to construct the new garage. <br /> <br />Motion by Commissioner Shumway and seconded by Commissioner LaDue to adopt <br />Findings of Fact 0168 relating to Mr. and Mrs. McCurry's request for a <br />variance from Section 170.015G of the City Code. (Please refer to findings <br />of fact file for Findings of Fact 0168). <br /> <br />Further Discussion: Mr. McCurry stated that the buildings on his lot would <br />have about the same road setback as his neighbor's buildings do; the new <br />garage would be constructed with the same materials as the home; existing <br />garage will be converted to living space. <br /> <br />Motion carried. Voting Yes: Chairman Zimmerman, Commissioners Shumway, <br />Holm, LaDue and Hendriksen. Voting No: None.
