Further Discussion: Commissioner Hendriksen stated that he feels the
variance should state that the structure will be constructed with the same
materials as the principal structure and that size, function, etc. will be
according to ordinance. Commissioner LaDue disagreed and stated that the
purpose of this Board is to address the variance to structure location, not
building materials. Commissioner Holm noted that Mr. McCurry's lot is less
than 2.5 acres and ordinance states that accessory structures and garages
on parcels less than 2.5 acres are required to be constructed with the same
material type as the house. The Board added the following item to the
proposed variance from Mr. and Mrs. McCurry:

#5 That the existing attached garage will be converted to living
space.

Motion carried. Voting Yes:
Holm, LaDue and Hendriksen.
Howell.

Chairman Zimmerman, Commissioners Shumway,
Voting No: None. Absent: Commissioner

Case #3:

Request For Variance From Section 170;015G Of The City Code
%o Construct An Addition To Garage Located Nearer The Front
Lot.Line Than The Princioal Structure: Case Of Mr. Jerry

Mr. Nyberg was present requesting approval to construct a 10.5' x 30'
addition to his garage which is located in front of the house. The
addition would be constructed of the same materials as the existing garage
and home.

Motion by Commissioner Shumway and seconded by Commissioner Holm to adopt
Findings of Fact O169 relating to Mr. Nyberg's request for a variance from
Section 170.015G of the City Code. (Please refer to findings of fact file
for Findings of Fact 0169).

Motion carried. Voting Yes:
Holm, LaDue and Hendriksen.
Howell.

Chairman Zimmerman, Commissioners Shumway,
Voting No: None. Absent: Commissioner

The Commission reviewed the proposed variance. Commissioner LaDue stated
that he feels it is inappropriate for a variance to address building
materials and he therefore disagrees with Item #1.

Motion by Commissioner LaDue and seconded by Commissioner Shumway to delete
Item #1 from the proposed variance and replace it with the following:

1) The proposed size of the addition to the garage is 11' x 30'.

Motion carried. Voting Yes:
Holm, LaDue and Hendriksen.
Howell.

Chairman Zimmerman, Commissioners Shumway,
Voting No: None.
