PROPOSED FINDINGS OF FACT <br />HR. GA~WETT PETTERSEN <br /> <br />1. That Mr. Garnett Pettersen, hereinafter referred to as "Applicant", has <br />properly applied for a Board of Adjustment variance from the required <br />setback from thoroughfares. <br /> <br />2. That the Applicant appeared before the Board of Adjustment for a public <br />hearing pursuant to Section 170.013G of the City Code on July 23, 1987 and <br />that said public hearing was properly advertised and that the minut.es of <br />said public hearing are hereby incorporated as a part of these findings by <br />reference. <br /> <br />2. That the subject property is that portion west of Cry. Rd. ~56 of the <br />property legally described as follows: <br /> <br />The north three-quarters of the north half of the northwest <br />quarter of the northwest quarter of Section"22, Township 32, <br />Range 25, Anoka County, Minnesota excepting therefrom the <br />following described tract: That part of the north three-quarters <br />of the north half of the northwest quarter of the northwest <br />quarter of Section 22, Township 32 north, Range 25 west, <br />described as follows: Commencing at a point on the north line of <br />said northwest quarter of the northwest quarter, distant 165 feet <br />west of the northeast corner thereof, then west along said north <br />line a distance of 264 feet, then south at right angles a <br />distance of 165 feet, then east parallel to the north line of <br />said northwest quarter of the northwest quarter a distance of 264 <br />feet, then north a distance of 165 feet to the point of <br />beginning, subject to the rights of the public over Cty. Rd. #56, <br />except ~3200. <br /> <br />3. That the subject property is located in the R-1R Rural Residential <br />District and is approximately 7/8 of an acre in size. <br /> <br />4. That the Applicant is requesting a variance from the setback from the <br />thoroughfares required in Sections 170.015F and 170.016A of the Ramsey City <br />Code. <br /> <br />5. That Sections 170.015F and 170.016A specify that the minimum setback <br />from the thoroughfare shall be at least 110 feet from the centerline of <br />thoroughfares. <br /> <br />6. That the Applicant is proposing to construct a home on the subject <br />property to be located approximately 70 feet from the centerline of County <br />Road ~56. <br /> <br />7. That the Applicant is requesting a variance to encroach on the required <br />setback from County Road ~56 by approximately 40 feet. <br /> <br />8. That the subject property was split from the remainder of the original <br />parcel by the construction of County Road #56. <br /> <br />9. That there are unique circumstances applying to the subject property, <br />namely the construction of County Rd. ~56 and the subdivision of the <br />property from the original parcel, that do not apply generally to other <br />properties in the R-1R Residential District. <br /> <br /> <br />
