The City Code ReEardin~ Setback From Thoroughfares~ Case Of Mr. Robert Muller: Ms. Norris noted that the site plan for Mr. Muller's shopping center was reviewed by City Staff, City Engineer, Planning and Zoning Commission and City Council; the 110 foot setback from St. Francis Blvd. was overlooked; construction has begun and the structure setback is 83 feet (which coincides with the Northern Bank setback on the north side of 167th Avenue). Ms. Norris noted that in the development agreement, Mr. Muller has agreed to provide easements for improvements to St. Francis Blvd. when it becomes necessary. Motion by Commissioner LaDue and seconded by Commissioner Shumway to adopt Findings of Fact 0173 relating to Mr. Robert Muller's request for a variance. (Please refer to findings of fact file for Findings of Fact 0173). Motion carried. LaDue and Holm. Howell. Voting Yes: Voting No: Chairman Zimmerman, Commissioners Shumway, None. Absent: Commissioners Hendriksen and Motion by Commissioner Shumway and seconded by Commissioner Holm to approve Mr. Robert Muller's request for a variance from Sections 170.015F and 170.016H of the City Code. Further, that the proposed variance be amended as follows: Add Item ~3 to read as follows: 'That the applicant shall provide a 50 foot easement from the centerline of St. Francis Blvd. for future improvements to St. Francis Blvd.' Motion carried. Holm and LaDue. Howell. Voting Yes: Voting No: Chairman Zimmerman, Commissioners Shumway, None. Absent: Commissioners Hendriksen and ADJOURNMENT Motion by Commissioner LaDue and seconded by Commissioner Holm to adjourn the regular Board of Adjustment meeting. Motion carried. Holm and LaDue.
