14. That John Stine, DNR, has reviewed the Applicant's request and has <br />stated that he has no objections to granting the variance provided that the <br />Applicant agrees to proper erosion control measures on the subject <br />property. <br /> <br />15. That City staff misinterpreted the provisions of Section 170.076 of the <br />City Code and issued a building permit to the Applicant for a structure <br />which encroaches on the required Rum River setback. <br /> <br />The motion for the adoption of the foregoing findings of fact was duly <br />seconded by Commissioner Holm and upon vote being taken thereon, the <br />following voted in favor thereof: <br /> <br />Chairman Zimmerman <br />Commissioner Hendriksen <br />Commissioner Holm <br />Commissioner LaDue <br />Commissioner Shumway <br />Commissioner Terry <br /> <br />and the following voted against the same: <br /> <br />None <br /> <br />and the following abstained: <br /> <br />None <br /> <br />and the following were absent: <br /> <br />Commissioner Howell <br /> <br />whereupon said findings of fact were declared duly adopted by the Ramsey <br />Board of Adjustment this the 24th day of September, 1987. <br /> <br />ATTEST: <br /> <br />Chairman <br /> <br />City Administrator <br /> <br /> <br />
