Shumway noted that the patio doora are already installed and it appears the Brettachneidera assumed the variance would be automatic. Chairman $humway suggested deleting Item ~9 from the findings of fact regarding the granting of the variance not being materially detrimental to the purposes of the zoning chapter. Commissioner Zimmerman suggested that the finding be amended to read that the granting of the variance may be detrimental to the purposes of the zoning chapter. Chairman Shumway stated that granting a variance with no proof of hardship is detrimental to the purposes of the zoning chapter. Commissioner Zimmerman inquired if there are any physical characteristics on the Brettschneider property that would create a hardship. Mr. Brettschneider stated that the physical layout of the property dictated where the home could be built as a walkout. Motion by Chairman Shumway to amend Item ~9 of the findings of fact to indicate that the granting of the variance will be detrimental to the purposes of the zoning chapter. Motion failed for lack of a second. Motion by Commissioner Zimmerman and seconded by Commissioner LaDue to amend Item #9 of the findings of fact to indicate that granting of the variance may be detrimental to the purposes of the zoning chapter. Motion carried. LaDue and Terry. Howell and Holm. Voting Yes: Voting No: Chairman Shumway, Commissioners Zimmerman, None. Absent: Commissioners Hendriksen, Commissioner LaDue inquired if the porch was part of the original home blueprints or an after-thought. Mr. Brettschneider ~tated that the porch was part of the original blueprints but when it was determined that the porch would encroach the rear yard setback, the building permit for the porch was separated from that of the house application so that construction of the principal structure could begin. Motion by Commissioner Zimmerman and seconded by Commissioner Terry to.add Item ~11 to the findings of fact to read as follows: 'That the building permit for the porch was applied for after the building permit for the principal structure was issued.' Motion carried. LaDue and Terry. Howell and Holm. Voting Yes: Voting No: Chairman Shumway, Commissioners Zimmerman, None. Absent: Commissioners Hendriksen, Motion by Commissioner Zimmerman and seconded by Commissioner Terry to add Item ~12 to the findings of fact to read as follows: 'That no proof of hardship has been forthcoming from the Applicant.'
