CASE # <br /> <br />CONTINUATION OF PUBLIC HEARING <br /> <br />INTRODUCTION OF ORDINANCE 'ON THE ESTABLISHMENT OF A <br />SPECIAL SERVICE DISTRICT FOR AUAR ROADWAY IMPROVEMENTS <br />By: Brian Olson, Asst PW Directoi'/Principal Engineer <br /> Diana Lurid, Finance Officer <br /> <br />5 <br /> <br />Background: <br /> <br />A public hearing was originally held on JUne 8, 2004, with it t° be continued at a <br />following council meeting. <br /> <br />The City of Ramsey entered into a Master Development Agreement with Ramsey Town <br />Center LLC on September 17, 2003. Section 4.19 entitled 'SPECIAL SERVICE <br />DISTRICT - AUAR ROADWAY IMPROVEMENTS', which states that the City may <br />adopt an ordinance ordering a special service district pursuant to Minnesota Statutes, <br />428A, fo finance its involvement in the AUAR Roadway Improvements. <br /> <br />This same section of the development agreement also states that if the City establishes a <br />Special District to finance the roadway improvements, that the Developer, for itself and <br />its successors and assigns, hereby waives the right to object to the establishment of the <br />special service district, waives its right to appeal the establishment of the special service <br />district, and waives its rights to file an objection to the ordinance or ordinances. <br /> <br />The Special Service District would be created to help fund the Regional Roadway <br />Improvements which consists of Armstrong Boule'card, Bunker Lake Boulevard and <br />Ramsey Boulevard. <br /> <br />Public Notice: The public hearing was properly notified in the Anoka County Union for <br />two weeks. Notices were also sent to Ramsey Town Center LLC, PACT School and DR <br />Horton. <br /> <br />Recommendation <br /> <br />City Staff recommends introduction of the Establishment of a Special District ordinance. <br /> <br />Council Action: <br /> <br />Motion to introduce Ordinance #04- to establish a Special Service District for the <br />regional roadway improvements in the Ramsey Town Center Addition. <br /> <br />-119- <br /> <br /> <br />
